HI,
A Few days ago I purchased a new television from Comet............its a nice telly with digital already in it.
Got it home set it up and the picture is really poor quality when we plug the Ntl into it. Also if we record anything the picture is all wrong.,yet ok if we use our spare television.
So i phoned comet saying we not happy with it and they told us they will send out an engineer next week! We want to return it straight back to the shop but they have said NO the Engineer must call.
I told them even if he fixes the TV I dont want a broken television from the start.
WHAT ARE MY RIGHTS ON THIS ? CAN ANYONE PLS TELL ME.
thanks x

Pretty sure you're within your rights to take it back to Comet and get a refund / replacement.0

http://www.dti.gov.uk/ccp/topics1/facts/salegoodsact.htm
• Wherever goods are bought they must "conform to contract". This means they must be as described, fit for purpose and of satisfactory quality (i.e. not inherently faulty at the time of sale).
• Goods are of satisfactory quality if they reach the standard that a reasonable person would regard as satisfactory, taking into account the price and any description.
• Aspects of quality include fitness for purpose, freedom from minor defects, appearance and finish, durability and safety.
• It is the seller, not the manufacturer, who is responsible if goods do not conform to contract.
• If goods do not conform to contract at the time of sale, purchasers can request their money back "within a reasonable time". (This is not defined and will depend on circumstances)0 -
Excellent advice from s_g. Comet are trying to fob you off to save themselves the cost of a new TV. However you have to ask for your money back "within reasonable time." This varies depending on the product, i.e it will take you a lot longer to work out a car doesn't fully work than a light bulb.
Make sure you e-mail Comet or write to your local store asap to advise them in writing of the problem "within resonable time." You will then have written proof (send your letter recorded delivery/keep a copy). The longer you leave it the more Comet will try to use it against you.
Having done that phone your local Trading Standards and ask advice on exactly which aspect of contract law Comet is in breach of.
Armed with that knowledge, march into Comet, advise the manager that he is in breach of contract in accordance with..........Act and that you require the full refund you are legally entitled to. Should he fail to respond advise him that you will be reporting him to Trading Standards and taking legal action against him.
