Court Fees for Divorce

Does anyone have any idea how much it costs to petition for divorce? I can't work out from Form EX50 exactly how much it will cost.

Any help appreciated.

    My partner had to pay his solicitor £300 for his petition to be sworn and then passed on to a judge at the court for hearing, as for further costs to this we are not sure as not long after it were sworn he were eligible for public funding through becoming disabled so being on benefits. His solicitor said any straight forward divorce should cost no more than £1200 from start to finish. Hope this helps.

    Just been there....done that! £300.00 to petition and then once you get the decree nisi, 6 weeks and 1 day later you can apply for the decree absolute it's another £40.00. Hope that helps.

  • Thanks for that. Does it matter on what grounds, or as long as you are doing most of it yourself does it stay relatively cheap?

    Four children involved from three different relationships, but visitation already agreed, and probably going by the calculation on the CSA website for maintenance so we just need someone to stamp the agreements basically.

    In my partners case it was on the grounds of unreasonable behaviour, (basically she was putting it around but courts cant use adultery as he didn't leave matrimonial home until after they had legally seperated) but the solicitor told us that as long as it is straight forward it should stay cheap.
    If you have already arranged visitation for children and any properties owned/leased by both of you have been settled including personal possessions then i think you have all the areas covered.

  • Thanks for that. I know if it's on the grounds of adultery I need to move quite quickly - happy not to name the other person as long as he's happy to agree that he committed it.

    i wasnt working at the time i got my divorce it was free, not sure if that is the case for you

    In the case of adultery you no longer name the other party, you just need your partner to agree thats what happended other wise they will only look at it under the grounds of unreasonable behaviour. My chap wanted her to have irreconcilable differences stated on the divorce but that terminology no longer exisists in divorce procedures. In case anyone wants to correct me this was correct at time of applying for decree nisi in january, upto now he doesn't have absolute because she wont declare her financial position as she doesn't want the matrimonial home selling from under her. Apparently now all financial dealings must be settled before absolute granted so there is no going back digging up old ground and as the final piece of paper states its absolute, all over nothing worth going back for.

  • Thanks. Hopefully we can sit down and sort out the financial side sooner rather than later - no assets to dispose of, so the only money to be decided is for the youngest child. After that, we can get on with our own lives.

    I work part time, so I don't think I can get it free - looks like saving up the £300 or splitting it between us.
