In response to previous post, the debt is c/crd £7744. The letter would b initial request for CCA,
CCCS say that yes, they can issue Stat Demand but there are ways to kill off further action as debt is personal and mtge/property is joint.
I have no intention of not paying, just my timescale is different to 1st Cr.
Also have no intention of moving house etc, ever, so voluntary charge is always an option, mind you i'd rather grant that to other creditors rather than this bunch of thugs!!!
CCCS seem to think that keep stringing 'em along on the re-finance route and ask for CCA at last minute would b a good route.
My brain hurts.

A couple of Q's if anyone can answer them.
Having looked around this forum and a couple of links,
i) Assuming that there is a CCA in place, this would have been signed between myself and the CREDITOR. Does the Assignment of the Debt to a DCA give the DCA the Legal Right to issue a default or demand....I didnt sign an agreement with THEM.
ii) Whilst waiting for AA Cr Crd to agree to go int free ( They have now and Blair,Orrible,Scott have got it, but behaving themselves ) they charged me £12 each month for BOTH overlimit and overdue fees, even though dmp with CCCS was in place.
iii) If fees have been deemed illegal, is the Agreement flawed and unenforcable?
iv) ( sorry ) when a CC is taken over by a new owner, Morg Stan to Goldfish should that then be covered by NEW, signed by both parties, agreement?
I'm sure that more q's will bubble up but answers to these would be great.

dont know how to set up new thread etc...computer thicky! but Deep in Debt mentioned, in another thread, about setting up a 1st Crud-it fan club...good idea.
I've just complained to the OFT regarding breaches of the Debt Collection Guidelines under Sections,
2.2 b, pressurising debtor to take on further borrowings or extend current..
2.2 f, pressurising debtor to pay in full, or make/increase payments when they are unable to do so..
2.2h, asking or instructing debtor to contact via premium rate phone...
2.8 d, contacting debtor directly and bypassing their appointed 3rd party representative...
OFT log the complaint, give a number, and if enough are made, then investigate ( anonymously, good ) 'on behalf of Consumers.
Also, original creditor ( Citifinancial ) could be in trouble by knowingly associating with a business in breach etc.
Must be pleny of potential complainants around.
