1st Credit !!

Hi Guys, my first post.
I have Plan in place with CCCS, all up to date ( couple with Blair Oliver and Scott ) but my problem 'people' are the commission-driven 'negotiators' at 1st Credit....Citifinancial just sold me to them! They threaten EVERYTHING within 7 days of buying the debt, I,ve written pointing out the CCCS plan ( which they are trying to ignore ) and keeping everything for the inevitable Summons!
I take it that 1st Credit have a record of this, I'd love to hear.

    Yes they do, pep. Stick firmly to your guns and they will, probably, come around to the CCCS proposals - it just takes time and a lot of patience.
    Don't worry too much about receiving the 'inevitable summons' from them - they, in common with any dcas of their ilk, will use all the threats at their disposal to try and squeeze money out of you - knowing that you are with CCCS they are unlikely to follow through with this threat - and, even if they did, the court would see that you are 'serious about your debts' and are following advice from CCCS. They are most unlikely to 'order' that you pay any more than the figure suggested by CCCS - in fact they could even reduce it, and 1st Credit would be just as 'bound' by any Court Order as you would be.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

    Yep. :rolleyes:

    Have a search back through the forum and you will find a lot of threads.

    They are no more likely to take you to court than any other debt collector; i.e. unlikely but not impossible.

    I'll put this in a new thread in a sec so that people who have dealt with them might notice your post more easily.

    Thanks for the support, just spoken to my to my caring, sharing negotiator who has given me 7 extra days ( i'm honoured! ) to raise the money.
    She also says that they do not respond to letters as they are a telephone based company...
    They claim to have spoken to CCCS, but are still threatening a Stat Demand.
    11 out of 12 creditors are happy with current arrangements ( 12/12 before this lot!) but I think I'm being targetted cos of £60K debt and £60K mort on £180K house with 5yrs mtge left!!
    Should I be asking for copies of CCA ?
    Do I just tough it out and rely on the CCS DMP?
    Anyone do free holidays?:mad:

    just wanted to say that they will have to communicate with you in the way you choose. If they say they will not put it in writing, just change your phone number (I know its a hassel but well worth it) then send a recorded delivery letter (you don't need to do this but it always helps to have a paper trail) to inform them that you no longer have a phone and that all communication will HAVE to be in writing. This is so much better for so many reasons.

    What was this debt for? How old is it?

    If it is a debt that should have a CCA and they are threatening a stat demand, then requesting the CCA may be a prudent move right now.

    Creditors only need one method of communication and that is either telephone or in writing. 1st Credit will ignore your letters and I just ignored their phone calls, so they had to write to me in the end! You may tend to find that 1st Credit will be a pain in a!!!! for a while. They were with me, but eventually they accepted my original offer through the CCCS. They just like to see if they can get more out of you first. They become quite tiring after a while but don't let them grind you down.

  • The lovely people at 1st credit get paid commission for debit card payments they take over the phone. In my experience they are prepared to go to any lenghts to bully and scare money out of you in this way. Don't let them. They were the only creditor to give me any trouble at all over my debts. I just stuck to my guns, refused to speak to them over the telephone and put everything in writing to them. They still refuse my monthly payment offer and have been taking me to court for the past few months but not received any court summons yet. Not worried if I do because I'm offering (and might I add paying even though they have asked me not to) more than the court would order any way.

    Make all of your communication with them in writing. If they say they refuse your offer just keep writing back 'sorry you feel unable to accept my offer of payment but you will see from my budget summary that this is the maximum offer I can make considering my current financial circumstances'. The more they repeat themselves, you repeat yourself back. Keep copies of all letters you send and receive and IF they take you to court you have all the proof you need that you have tried to be reasonable and make offers of payment that have continually been refused.

    Yep, they are very bullying and nasty. As others have said, don't speak to them on the phone - refuse to go through their security questions, give them your CCCS ref no and say you will only deal in writing and then hang up. They will probably send you letters asking you to call them which they did with me, but I just wrote back and told them I will only deal in writing. We went in circles for a few months until they eventually accepted my DMP payments. They've left me alone for a few months but I am expecting them to rear their very ugly heads again shortly so I will just carry on from where I left off!

    Have you already requested a CCA?

    Or do you mean that you need the initial letter to send?
