    Take that to the Ombudsman. Natwest did something similar to my Mother. Her wages would come in a day later than a lot of direct debits and transfers (yes, crap system but she must've had a reason) leaving her with an overnight negative balance so even worse. Knowing she had a regular payment in the next day they allowed the debits and the next day credit put her back in the black.

    After 5 months they charged her and then charged her retrospectively for everytime it had happened over the past 5 months. She took it to the Ombudsman who ruled that the Bank had to remove all charges. They paid some small compensation and made it clear they would charge for this procedure in future. She promptly closed the account.

    It's not an identical case but you could argue that they set a precedent, worth a shot at least to tell them you're taking it to the Ombudsman.

    Your available balance is the correct balance and yes A & L have a very confusing system.

    I look only at the available balance when checking my account.

    Banks do not always "take the balance at end of day". Some do, some don't - and some require funds for all of any day's payments to be in the account by the end of business on the *previous* day. A&L do that.
    i don't see how they can suddenly move the goalposts and change the way my account operated. as far as i was concerned it was ok.

    But as far as A&L are concerned, it was not okay - and no goalposts have been moved, as all of this is detailed in the terms and conditions of your account. You can find those t&c at http://www.alliance-leicester.co.uk/redirects/PDFredirector.aspx?url=catermsconditions - especially 19.4:
    If you do not have enough money in your account at the start of the day to cover the payments that are being made that day, we will decide whether or not to make the payment, If this happens you will incur a fee as described in our rates and fees information whether or not to make the payment.

    I'd say you've been very fortunate that they didn't charge you before now. Note that I'm not saying that this way of doing business is good or justifiable, but these are the t&c you agreed to when you opened the account.
