help with planning permission

Help :eek: I have just been told that I need planning permission to put down decking in my back garden, they are starting the decking tomorrow and i didn't even think about it, can anyone advise please....

    Situations Requiring Planning Permission
      <LI value=0>Where the deck is situated within 20 metres of a highway. <LI value=0>Where the deck is at 1st floor level or above. <LI value=0>If any part of the deck construction exceeds 3m in height. <LI value=0>If the structure would affect the amenity value or privacy of neighbouring properties.
    • If the deck is attached to a listed building or situated in a conservation area or National Park.
    i have just found this on the council web site & i have none of the above why do you think i still need need planning permission

    I'd be inclined to take a print of that from the council website, file it away in the important papers file (or whereever) and get on with the job. If anyone then comes around bothering about it, you can pull out your printout and say you checked the council website, the situations where PP is required didn't appear to apply to you, and so you didn't feel you needed to apply. Chances are that even if someone did come bothering about it you could apply for retrospective permission on the grounds that the council's website contained misleading information!

    A local councillor just called up said a neighbour had complained then did whisper to me they are just jealous of your garden, but she did say offcially you need planning permission she also said my fence was too high at 6ft should be five but thinks it will be ok now!!! WT heck

    she also told us we need to make the gates 5ft but cut six inc off will be fine....which we have just done..i got in such a fluster with her didn't question anything

  • Hmmmm I'd question the councillor's behaviour too. I work for a council myself and in our place it would be unthinkable for councillors to be going around giving that sort of advice. If she was genuinely concerned and trying to be helpful, she should have given you the contact details of someone in planning you could check things out with. I wonder if she's a mate of the neighbour and feeling pressured to do her a favour?
  • If the decking is raised, then yes you may well need planning permission as it has a measurable volume underneath - presume it's not level with the ground?

    Very misleading info from the council - most of that is wrong!!

    Are you sure it was a local councillor that phoned you. Normally if a councillor gets an enquiry from a concerned constituent the councillor should contact the appropriate Council department for them to check out wheter or not planning permission is required. It may be worthwhile contacting your Council Planning Dept to check whether permission is required or not.
