Hi All,
As I am sure many of you know, when it comes to knowing exactly what you are entitled to or able to claim for it's a bit of a dark-art to say the least!
Call me a cynic, but I suspect it's done for reason (to save money), but that is just my opinion.
I know there are those who will just site JSP this - JSP that, but to be fair, not everything is made as clear or accessible as it should be when it comes to entitlements and claims. And to make it more annoying, there are differing opinions/interpretations on the same topics most of the time too. You know "do I need receipts for this" or "can I carry over my entitlement" or "can I claim a laundry tax or not?" etc. etc.
So, I wonder if it would be a good idea to use this area to post any claiming or entitlements you make that others would benefit from?
Please be as specific as possible and include if possible references to any documents.

annie sorry but if you don't know what they are, then clearly you are not in the forces and no requirement to need to know what you can claim,
However if you are a WAG then just tell the OH i'm sure they will know;)0 -
Hi,
Not one for those currently serving but may have an impact when leaving if anyone picked up any injuries/illnesses whilst serving. However please not this only applies to an illness/injury occurring on or before the 5th April 2005.
If you became injured whilst serving, and this injury/illness occurred before 5th April 2005, you may be entitled to a War Pension or Gratuity depending on the level of injury and its residual effects. The important thing though is to put a claim into the Service Personnel and Veterans Agency (SPVA) within seven years of discharge.
The importance of the seven years is that, if a claim is put in before the seven year point, the Secretary of State for Defence (viz the SPVA) has to prove 'beyond all reaosnable doubt' that an injury/illness was NOT attribuatable to service.
After the seven years is up, the decision whether to pay a War Pension or Gratuity is on a 'balance of probabilites' basis. Incidentally the 'balance of probabilites' is also used for the 'new 'Armed Forces Compensation Scheme for illness/injury occurring on or after 6th April 2005.
It might not sound much difference, but in the former case, you will be awarded a War Pension or Gratuity for illness or Injury unless the SPVA can prove beyond reasonable doubt that said illness/injury did not occur due to service reasons - ie if there is any doubt as to how the injury came about they have to pay out - they have to prove you are not entitled to a War Pension/Gratuity.
In the latter case the SPVA can decide not to pay a War Pension or Gratuity or AFCS claim if they believe the injury did not occur due to 'Service Reasons' based on balance of probabilities - ie it is upto the claimant to prove the illness/injury occurred due to service reasons.
So it is definately worth putting in a claim within seven years of discharge. Even if the injury does not really affect you at the moment, but might in later life - still put in a claim within 7 years.
Incidentally for those injured post April 2005 you only have 5 years maximum from the date of illness/injury (or seeking medical treatment for same) or if there was no actual incident causing the injury/illness, a maximum of 5 years since discharge to make a claim. Any late claims will not be accepted unless in very exceptional circumstances.
If claiming a War Pension, Gratuity or under the Armed Forces Compensation Scheme, various ex service charities such as the Royal British Legion, RAFA, etc can provide help, assistance and even representation at Tribunals completely free of charge - and you do not actually need to be a member of the organisation (although if they get you a Pension etc it might be nice to join and help others in the same position).
Regards

I've only ever been wrong once! and that was when I thought I was wrong but I was right0 -
Isn't there something that says you can only claim incidentals for any 24 hour period? So if you are only attending a meeting for a few hours, you can't claim. But if it involves an overnight stop, you can.0
