Id be pleased to know what response you get from the council as Im having a similar situation. The people who live next door have moved and rented their house to a family who have just been thrown out of a rented house at the other end of the village for running a business from there. He seems to be doing up cars to sell. He's been in for about 2 weeks and so far no major probs except several cars being parked in his drive and on the grass verge in front of his house. However last night a big truck turned up with loads of machines/tools and this morning there has been something that sounds like an angle grinder running for about 2 hours in the garage. Im quite happy to live and let live if hes not causing a nusience but want to know wheter the council are likely to do anything as the houses are not council houses. Also there are covenants on the house not to run a business from them but I thought only the builder could enforce these?

Alm721 - Council won't do anything unless you (or someone else) reports him to either (or both) Planning or Environmental Health. Knowing some of the councils I've dealt with, you would have to have some comprehensive evidence before they'd even bother to come out and have a look.
If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

Alm721, further thought - you could inform his landlord about what is going on, perhaps his 6 mth tenancy won't be renewed.

Further to my previous post #6. I would just like to add, that neighbourhood/ nuisance disputes of this kind are extremely difficult to resolve, and most sizable LAs will have several a day to deal with. I have dealt with scores of them!

I do appreciate that inconsiderate/antisocial neighbours can blight a whole community. However generally speaking, the type of people that cause this kind of problem, take no notice of polite visits/letters from Local Government Officers.

When dealing with similar complaints I have been threatened with violence and even had dogs set upon me - also threatened whilst "off duty" out shopping on Saturday with my family.

These cases can also take a huge amount of resources including case officer time, colleagues from other depatments, solicitors etc.

I do however feel, that such antisocial people cause untold missery to those around them and should be dealt with whatever the cost, but please remember, WE ALL PAY THE BILL.

may be worth contacting the environment agency as he would need various licences including a carrier and broker licence if they are buying or seling scrap metal or other recoverables oprating from a yard or as a middleman, making the buying and selling arrangements for the transaction of scrap metal.Anybody who is collecting end of life Vehicle's need's to be registered as a waste carrier.

They are usually quite prompt in responding

  • Yep definitely sounds like a material change of use - also the council have powers under section 215 of the Town and Country Planning Act 1990 to force land owners to clear up land which is very unsightly. My council has served quite a few recently, one of which included removing several old battered cars from a garden.
  • Hi All,

Many many thanks for all your replies so far, I do really appreciate it...I did feel very much alone with this situation until I came on here.

I have been assigned an Planning Enforcement officer so we'll see what happens there, I shall also be taking all your other advice on board too. I don't feel like I want to take direct action myself though (Vicious dogs don't sound like something I'd like to confront)

Anyway, thanks again - I will keep you all informed.

What if kids get in and set fire to the cars and damage the buildings nearby.

Now, wouldn't that be a shame. You could perhaps helpfully leave some matches and paraffin lying around. Maybe with a large notice saying 'Beware: Flammable Materials Stored Behind This Hedge'.
No reliance should be placed on the above! Absolutely none, do you hear?
