                    help! my mum needs some advice please..
she sold a gold bracelet to a buyer in austrailia, it took 2 days to get there,
the buyer e-mailed her to say the bracelet was broken and she wanted a partial refund to mend it..
the bracelet was in A1 condition when sent, my mum refused to send payment but offered a 100% refund on return of bracelet, buyer initailly declined, saying she did not beleive mum would refund the money.
my mum a 100% feedback, this woman has lots of negs..
21 days later the bracelet arrived broken and buyer left nasty neg feedback and is trying to claw payment back?
if you buy something on ebay and then break it, can you get your money back?

            If you pay through paypal and return an item for a refund, then you must send it via a trackable method. So if the buyer didn't do so, they can't prove to Paypal that it was received by your mum, so I would think that your mum wasn't liable for the refund...0

 Who said it was tracked when it was sent? No mention of a dispute yet - buyer could open an INR!
 We don't know how the bracelet is broken... heaven forbid... could the buyer be telling the truth?My TV is broken! 
 Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0

 my mum is quite honest and e-mailed her to say she had received item.
 the point is the buyer has broken the bracelet and is asking for a refund..
 obviously my mum has no proof of this, is she gonna have to cough up?
 ideas anyone??
 this woman sent really abusive e-mails calling my mum a b$tch etc, can she forward these messages to e-bay?£608.98

 bracelet was sent in good conditon and packaged well, it has been returned with a broken link 21 days after the sale£608.98

 If the buyer wanted to play dirty, they could claim it had never arrive, and you'd be expected to provide tracking to prove it had.My TV is broken!

            thanks, the item was received by her, she is not disputing this , its just she said it was broken which it was not at time of sending..
 to break a link it would have had to have been opened..
 tbh its the abusive e-mails which have really upset my mum..
 she (the buyer) has opened a dispute saying item was not as described..
 we are most likely fighting a losing battle here, just wondering if anything else could be done!£608.98

 One problem with this. I bought an item that was faulty on arrival. Imediately contacted seller and told him that I would return at my own cost for a refund. He refused even though he had 14 day refund on returns in listing. I pointed this out but he said his small print said NO returns. I reasonably informed him that if he meant this why did he not check the NO returns option on Returns info instead of 14 days!!??
 Obviously an unreasonable person so immediately filed a dispute as wasn't gonna get anywhere with him. Paypal then wanted independent eveidence in the form of a fax that the item was faulty. Would have cost more than the item £13 + £3.50 P+P.
 Was resigned to the fact that I had been ripped off again on Ebay.
 Paypal a couple of weeks later said I could get a chargeback if I returned item and sent trackable.
 I sent 1st Class recorded last Thursday - a week ago. Funnily enough it hasn't arrived. I suspect the guy has ignored the postman, been carded and not picked the item up from the Post Office. I immediately let Paypal know the tracking number last week but they obviously passed this on to him. I know he has been to the PO as he has sold and sent other items in this time!!
 I have 3 days to provide tracking then dispute closed.
 Result = I am out of pocket to £16.50 off seller, £2.50 return item and no item or possibility of refund.
 This guy will be getting Negged VERY strongly. I am even considering taking him to the small claims court as my money will be refunded in it's entirety.
 I know it is a relatively small amount but if someone stold £20 off me I would report them to the police. Not happy with Paypal or Ebay but as usual they don't give a F**K0
