does personal accident insurance ever pay out?

i had accident cover for me and hubbie, i had rta in 1996 and claimed,as i could no longer work, the woolwich refused to pay out saying they did not know if i would never work again,they offered me a token amount saying if i did not accept it then i would get nothing! while all this was going on i was still paying insurance and my husband had terrible accident in his lorry leaving him with terrible hand, arm wrist and back injuries and he could no longer work.woolwich was informed and they did not even reply.we are both still having medical treatment, i am in a wheelchair,my husband cannot use his hands. the woolwich owe us £500.000 because our accidents stopped us working but we are struggling to pay for food and bills, we are living on incapacity benefit and dla. Please can someone help me get what is owed??? i am desperate

    I have known it to but I have also known a number of cases where they wont in which I consider it unfair.

    accident insurnace usually pays out on the total loss of use of limbs. Can you clarify if it is personal accident insurance or permanent health insurance or a payment protection plan?

  • it was personal accident insurance, with amounts awarded for different health probs eg loss of a thumb £10.000 etc. Not being able to work again was £250.000. I had so much damage to my spine i use a wheelchair and live on morphine (not good for the brain!!) my husband broke his hand off of his arm, and 16 ops later it is grafted on but there is no movement of the wrist,making his right hand useless and his left hand was broken up too and arthritic disease has set in.we are both still under the hospital and receiving treatment, and will do for the rest of our lives.what i am worried about too is how long ago it happened, surely i have some rights?
  • Take your case to the Financial Ombudsman Service, it takes time but does not cost anything I am not sure if there is a time limit on complaints. I had two personal accident policies when my husband died, one paid with no problem the other refused, after dragging things on for a year, it took another year but the FOS did resolve it in my favour. There have been other similar cases so it is certainly worth a try.
