Married Quarter when you have LSAP

Hi guys
Does anyone know if you can get a married quarter when you have already taken out LSAP to buy a house???

I have a one bedroom house (all we could afford when we bought) but I have 2 children from a previous relationship and want to start trying for a new baby, we can't afford a bigger house because the CSA is robbing us blind! Is there anyway around this does anyone know? (we have our house on the Market but with little I interest in the current climate!)

    This is a extract from JSP 752.

    02.0446. Entitlement to Service Families Accommodation (SFA). Personnel
    assigned with their immediate family to an area (within 50 miles) in which they own a
    property purchased or extended with the aid of a LSAP are required to occupy that property and are disqualified from occupation of SFA or SSFA, at the new place of duty, except for the following reasons:

    a. Their CO is satisfied that the property remains beyond a reasonable daily
    travelling distance; or
    b. They are required to occupy SFA by virtue of their appointment.
    c. They are separated from their spouse/civil partner (who continue to live in
    the property purchased using an LSAP) and they require SFA to facilitate staying in contact with their children.

    If you sell your property then you will be required to repay the LSAP back in full unless you are purchasing another qualifing LSAP property.

    Having been through this, it can be quite complicated.

    You can have a MQ in your base area if you have LSAP as long as the house you have the LSAP on is
    1. Either not in your base area and not the area you want the MQ in.
    2. In the process of being Sold and you pay back the LSAP as soon as the property is sold.

    The rules may have changes since we went through it but you can check all up to date details by following links found on www.rncom.mod.uk

    Which is also brill for family members if you are away as they can stay in contact with other family members of the same ship/unit.

  • Dependant on which scheme you are on (new or old) given the circumstances you have just mentioned contact them for a re-assessment asap you may be surprised.

    New scheme allows a sliding scale for any children that currently live with you but not housing costs

    Old scheme allows for all housing costs inc council tax and the children living with you.

    If you have debt with the CSA they are always open to negotiation with that make them an offer and they usually accept it, remember the debt with the CSA is interest free so if you have other debt pay that first and offer them what you can realistically afford - although this only applies to the debt not regular maintenance

    Thanks for that guys...... In that case, I now have a second question (sorry!) what if we didn't have the LSAP??? I mean, if we paid that back would we then be able to get a quarter?!
  • If you repay the LSAP and the house is not in your base area then yes

    If you repay the LSAP and the house is in your base area and you rent the property out then No

    If you repaid the LSAP back then you would be entitled to occupy a MSQ.
  • I took out £8K LSAP to buy my first house when living in, in 2003. I was in the South East, and the House in the NW - the distance between my duty stn and the property I explained as the house was in my home town, and I was expecting a posting to the area. No problems.

    I got married in 2004 and moved into quarters in the SE. I then rented out the house (recommend full managed service through a letting agent) which needed permission to let from the mortgage company, and then had to pay a small LSAP insurance each month along with the LSAP.

    It's been like that now for 5 years, no problems. We moved into our own house here in the SW a year or so ago from quarters, and the only promise I had to make is to clear the LSAP if I ever sell the LSAP/Rented house. I retire in 2 years and if I still have the house in the NW, then the remaining LSAP (a steadily reducing amount) will be taken out of my lump sum.

    As far as I understand the regs you are entitled to occupy SFA in the same area as your private property as long as you have paid off the LSAP. On the SFA application form (MOD Form 1132) section 3 asks "Do you own a property within 45 minutes travelling time from your new place of duty which you have purchased/extended with the aid of an extant LSAP loan?" - the key word here is 'extant' - if you have paid of your loan then your private finacial affairs/investments are no ones business but your own.     For further clarification JSP 464 Part 1 ...

    0314. Long Service Advance of Pay (LSAP) claimants. If the Service person
    purchases (or extends) a property using the Long Service Advance of Pay Scheme(LSAP), there is no entitlement to SFA at that place of duty, or any other place of duty within 50 miles of the property, during the period that the LSAP loan is being repaid. Exceptions are detailed in JSP 752 Chapter 2 Section 4 para 02.0446.
