    As with the union TBH there is no such thing like this there as its full of EU workers on min wage. They are in the process of bullying the british workers out of the door to replace them with cheap labour from Poland etc... - tictics used are overtime (as requested by management- with 1 hours notice before the end of the shift) - those who have company part funded taxis get the cancelled at the last moment so they have to work said overtime with no choice - I find this very unreasonable.

    I will be gathering all doc's this week for the period owed now - as with point 4 above, since I have clocked up 1 months pay in overtime I can if wanted to offset this against the 4 weeks leave notice - hence walking out of the door tomorrow if I wish. But I can't do this yet as I need to have another "secure" job to go into as I have a mortgage to pay for. Hopefully in a true MSE sense I will be in a local job a mile away from me, so I can walk or bike to work, saving me wear/tear + petrol costs on the car for the 50 mile round trip at the moment.

    Point 3 is totally correct - they promised payment before xmas, but that never happened - this somewhat dampened my spirts over the xmas time with them as I wanted the cash to pay off the credit cards once and for all. But with pending bills coming very soon with the car as its needs new tyres to the tune of £250 I really need it at the end of this month - this is something that they don't seem to understand. Deadline for overtime payment requests are for the 10th of every month, I make my requests with the paperwork 1-2 weeks before the deadline but they always leave it to the last mintue. When something is sorted out the deadline is missed.

    The other lass who also started on the course at the same time leaves next week as she is moving away - hence way this has all fired up

    TBH the company stinks and stinks real bad in the last few months since the fire
  • Just a little update - as far as I know someone in the firm as mentioned that what they are doing is wrong. So my overtime and mileage forms have now been processed to the correct deptements. I am waiting to see if payments are made into my bank for these.

    If they are - then I will proceed to present the firm a 4 week notice of leaving my job when I get another one more lcoal to me.

    You sound like you're pretty young. Just get out of there.

    Say to yourself, "In 5 years I won't be here and none of this will matter."

    Play it by the book, be bloody awkward and strong, put all of this down in writing stating the points you have made.

    There's two reasons for this; Firstly, if you need to recover monies from them via tribunal then you will have to have written to them while you were still there. "Correspondence detailing Grievance," I think is the correct term. YOU MUST PUT THIS IS WRITING TO THEM.

    Secondly; by the time they've got so utterly fed up with you and sacked you, you can claim JSA. There is also the chance that the Job Centre will investigate this situation on your behalf. If you leave however, you get nothing. You have to make them sack you.

    Are they likely to start hitting you and threatening you with physical violence? NO! Are they likely to just be unpleasant and awkward with you? YES! "Sticks and stones may break my bones, names will never hurt me."

    As for these course fees, it is common practice for companies to retrieve these if the employee leaves within a year, but it requires the contract to be rewritten. During the tech boom everyone was doing their MCSEs on behalf of companies then doing a runner, hence the corporates started to crack down.

    BE STRONG. Go for it ;)

    It also might be a good time to track down old (reputable) contacts for references.
  • Oh I was bloody awkward last night - they ask me to sign - said No, they asked again. More less what part of No don't you guys don't understand. Then it was torn up in front of me and my supervisdors. he could or can I believe what happend :D

    Now I gonna be more awkward in the coming few weeks ;)

    xlt, If you're as unhappy in your job as you sound just get out! Carry on like this and the only thing that'll happen is you'll make yourself ill (does your present firm pay sick pay??)

    Hi xlt :-)

    ASG has a point actually about making yourself ill, it can happen, I've been on the receiving end before and stuck it out for 3 months before being given notice. Going into work everyday when you hate every moment of it is utterly horrible and a drain.

    But, it can be done, just draw strength that you won't be there forever and that you're in the right. They can't force you to sign that document to now get you to pay them £££, that's their !!!! up and their problem.

    Never ever be late, play it by the book. (((((hugs)))))

    Oh and ripping up a document in front of you is intimidation and unprofessional. The intimidation bit sounds needy, the unprofessional bit is real.

    The other thing to do here is to keep a brief diary, but then you will go mad. ;-)

    In 2 years to time none of it will matter.
  • You know, I was looking into the fact of going on the sickie - but its not me at all. I did have a appointment with the quack for the infected eye but cleared up but was going to ask her if I am suffering from stress.

    TBH I do feel the strain and drain - I hate the travelling now as it bores me - so does work now as I heard it all before. Yap, Yap yap with this firm - all they talk about is going higher in the firm - get real if it happens it happens, but don't talk about it get ppl's hopes up. Neverless I am looking and have applied - i will get out and will be strong in the mean time - as I am young a career change back into IT would be a good idea I think :)

    Can you explain the Intimidation bit as I am now thinking in the process of going down the Grievance route as they still have not sorted out the payment of overime owed and can use this as a major + extra point in the complait as you said its Intimidation and unprofessional of the firm to do this.

    From what you have said there is a HR department? Get a written grievance in asap. Detail everything that has happened, including the non payment of wages. This way if you end up resigning you have covered the legal bases before the tribunal route.

    In your greivance I would detail the incidents and state that you fell victimised and intimidated. The level of stress they are putting you under is unacceptable, as is attempting to impose a retrospective repayment agreement.

    Have thye persued costs against other leavers? Discrimination?

    The other option is just to raise a formal complaint about the non payment of wages, in writing. As you have said you then just have the option of walking away. They may try and bluff for the course fees but without paperwork to prove it they are going to struggle in court.

    I have (unfortunately only a vague one though) memory of being told by our legal advisors that for such agreement to stand a chance it has to be signed prior to commencement of the course in any case. If they deduct the money then you take them to tribunal for non payment of wages, you can prove that they owed you the money, they will struggle to prove that you agreed to any repayment. Anything money related requires paper to prove it, it is an area were custom and practice does not carry a huge amount of weight.

    I know how hard it is to find jobs in Lincolnshire so I wish you every success and hope something comes up quickly.
