Credit File Advice Needed!

    No the account is already "defaulted" / Terminated, they wouldn’t of repossessed the car and sold it otherwise!

    The debt will still be on their system but like i said it will just be that no one has noticed it is not on the chase list yet.


    On separate note you have made a lot of postings over the last few weeks about getting your credit file sorted and managing your debts.

    Have you actually contacted Payplan or the CCCS to see how they can help you?

    You seem to want resolve your debt / improve your credit rating but as yet have took no real positive action towards achieving this ?

    Perhaps you should consider posting under separate thread, all your debts, and your income and expenditure, then people can offer some real help and advice rather than you chasing your tail trying just to get your credit file repaired.

    You should also be confident that you are in a position to responsibly manage your finances, I see from the car loan that you only made 4 payments before you experienced difficulty, is you financial situation any better now? , and if not is it really wise to seek more credit anyway ?

    I have a friend helping me with my debts, im just trying to learn my position and options before i do ANYTHING.

    This is all a bit confusing, so who do i contact to get it removed after 28 days? Its no good them chasing me, as i dont have the money to give them. But its worth a try to get it off my report and to get the debt off!!!

    maybe i should do this for all my debts with the 28 day thing? Can you explain how i do it?

    My other debts are all small, just the car finance is big.

  • Lodge a “notice of dispute” with the credit reference agency for the accounts you dispute, ( legally you must have a valid reason for doing this, i.e the data is materially incorrect )

    If the lender responds then the data stays, if they don’t respond within 28 days then the CRA will “suppress” the data

    NOTE: this means that the data will not be visible to any credit search IT WILL NOT MEAN that the debt is written off, or not owed anymore. The lender can instruct the CRA to reinstate this data on the file at any point in the future up until the natural expiry date of the data.

    As i have said you should be aware that if you do take this route then the creditors that do respond will start to chase you.

    out of my 11 debts, how many will respond from that roughly, do you think?

  • Can debt collection agencies register things on my file?

    Everything on my file is from original creditors, even though they have been passed on?

    Relates Section 7 of the Data Protection Act where by a data controller has 40 Days to respond to a request for information from a data subject
