Won paypal chargeback but item has arrived.

I purchased an item on 10th Oct, paid straight away by paypal. A week later still hadn't received the item. Sent an email to seller to see if he'd posted it but got no reply. Next day sent another email but still no reply. I requested his details from ebay and phoned his number but it wasn't recognised. Decided to start a chargeback through paypal. The day after I'd started the chargeback I got an email from seller saying it would be with me in two working days. Eight days later I got the item (face cream) which was described as new but the box was all bashed because of the insufficient packaging and unsuitable to give as a gift. Emailed him again and told him I would be sending the cream back to him but never got a reply again. The next day I got an email from paypal saying i had won the chargeback as he didn't respond to their request for him to contact them. My problem now is, do I send him the cream incase he doesn't have funds in his paypal account and I end up out of pocket. Had a look at his feedback and he has received a neutral and a negative feedback today for this same kind of hassle I got from him. He only has 5 feedbacks of with an overall of 2. How do I go about reporting him to ebay as he is obviously a dodger.
This is my first ever problem with ebay.

    How did you fund your paypal payment? You may want to hang on to the item for now, as if you don't get your money back from the paypal chargeback and you paid through a credit/debit card, you might want to take it up with your card issuer as a 'not as described' claim. I think I would wait and see what happens.
  • I paid by debit card. I think I should wait and see what happens too. Just scared I end up with a negative feedback.
