Hi guys, need some advice.
I had an old toyota Yaris and wanted to upgrade to the new one so I went into Arnold Clark who had a silver one but it was being used by another member of staff so i couldnt have a proper look at it as it was filled with all his stuff. I was reassured by the sales man that it would be valeted and serviced but didnt need a mot as it was 1 year old, so i filled in paperwork and applied for finance.
I was called the next day top say everything was fine and the sale would go through and my new car would be ready to collect the following wednesday. I used my old car as part exchange and emptied everthing out, handed over the keys and signed all the documentation.
I was told the new car had £10-£15 petrol in it, and yet 5 mins from the garage the bar went to empty so i had to fill it up, there was no car mats, 4 cigarette burns which i was told he hadnt seen them (although my sister noticed, told him and he tried to shrug it off, she pointed it out to me so i went back to tell him)then he would have someone come out to repair this for me but i would receive a phonecall first for the company they use (still haven't got one) plusthere was no window wash fluid in the car.
I got a phonecall yesterday to say i was missing proof of address to get the finance, I told him i still hadn't received a phonecall about the fag burns and he said "You bring in your statement for me then i'll get that sorted out!":mad:
So obviously he hadnt told the company about my car with the 4 burns.
I then received a phonecall from a guy down England who told me he had bought my old car at auction yesterday and inside the car was all the signed documents (The ones I had signed when I picked up the car )with my bank details, car details, address, date of birth, everything really which had been left by Arnold Clark! :mad: The man said I was lucky as if it were to fall in the wrong hands, my identity could be stolen but he would send them up straight away and that he was shocked they could make such a mistake.
What should i do? I'm already think about handing the car back but dont really want to be left without a car as i need it to go everywhere and my old one was sold.
Sorry about the long post, Im just so annoyed and needed a rant and any advice would be appreciated.

Other than carelessness bordering on the reckless from Arnold Clark concerning the paperwork relating to the finance for the car, and the 4 cigaretter burns, why would you want to return the car?"You were only supposed to blow the bl**dy doors off!!"0

They may be saying they haven't got your proof of address to get the finance because they know they've lost the whole lot of documents.
They may be hoping you'll go in and sign it all again.
You could not tell them the documents are on their way back to you - don't let them know the documents were in the car auctioned, just take in proof of address - up to them to sort out.
When they realise they're in a pickle you can tell them to either take the car back or sort out what you want on it then you'll give them the documents back, otherwise they'll have to take the car back and lose the sale.0 -
Do you want to keep the new car?
If so, I think you should advise Arnold Clark of all of the issues and ensure that the deal that you made is the deal you get - with the seats being repaired etc.
If you would rather a quick way out then you have enough ammunition to achieve this.
As they have sold your car they would have to give you the cash equivalent of the part exchange price shown on your invoice.0 -
Ask the person who bought your old car to send the docs recorded delivery, re-imburse him if you have to, as if they go missing again then there will be a stalemate !!0
