Problems, What to do next

Hi, new here so be gentle

I bought an item off Ebay on the 11th of october on a BIN. Shortly after I recieved a message telling me that the item wasn't in stock but would be shortly. My first thought was, what you selling it for then but anyway..........
After a week or so of hearing nothing I contacted the seller again to find out what was happening an was informed that it would be sent within the next couple of days. Still nothing arrived :mad:
Yesterday I noticed that the seller had left me feedback, so I emailed seller asking if this mean't that the item was now on it's way. The seller has now been back intouch to say that it was sent a while ago and should have it :rolleyes:
Now heres the problem, there wasn't any insured postage option so I've only paid for normal 1st class delivery.
Who's problem is it to sort out? and what would you do next?

Oh and just to add to that, It was one of 5 bought BIN and only one has left feedback so I guess the others havn't recieved anything yet either.0

If you paid by paypal it doesn't matter whether or not you opted for insurance, you can start a chargeback and assuming seller has funds in his paypal account now or in the future, you will get a full refund.
However, it is best to ask the seller for a refund first as he might be happy to oblige rather than risk a chargeback although never mention the word chargeback to the seller as they might clear their paypal account. Just ask for a refund and depending on the response only then start a chargeback. You have a time limit of 45 days so are well within that time frame.
If you didn't use paypal then you will be dependent on the good nature of the seller to refund you.

Royal Mail classify items of mail as lost if they are not received within 3 weeks (15 working days) of posting. After that, the seller should offer a refund if they have not already done so, but Paypal chargebacks can be used earlier (after a week I think). I once contacted a seller to say that an item I'd bought about a fortnight previously had not yet arrived, and asking if and when it had been posted. The seller said it had been posted about 10 days previously, so I said I'd wait till RM's 15 working days passed to see if it arrived. The following day, it arrived in the post - postmarked the day before! I gave them the benefit of the doubt and assumed that it was after they told me they'd posted it 10 days ago that they realised they had actually forgotten to post it.0

The seller has 10 days to respond to the chargeback and either show delivery or refund you. If he does neither of those in the 10 days you will win the chargeback.
If by any chance the seller emails you and asks you to remove the chargeback, don't do it. Once stopped the process can not be restarted.

since I started a claim the sellers offered me a refund. How do I stop the claim when I've received it?

You don't have to as the seller can stop the chargeback by showing proof of the refund.
