Query re past problem with CC and credit rating

A while ago I had a capital one credit card (Jun 01) and I paid for PPI to cover in case I lost my job.
In Dec 01 I lost my job so decided to claim using PPI. I tried contacting the insurance company who said they would send out a form to claim, I never received a form and for the next few months I tried contacting both themselves and capital one to try and sort this out.
Despite calling the helplines and also writing letters of complaint I never received a form.
I stayed out of work for nearly 11 months and during that time I was paying my minimum monthly payment plus PPI until I had to default as my money ran out in Dec 02.
Once I started a new job I immediately repaid all debt to capital one and tried to sort out the PPI issues, I still never managed to get anywhere with it so eventually gave up trying to claim.
I thought that was the end of it but I recently decided to check my credit score as I am hoping to buy a house in the next half year, when I did I found that Capital One put a default on the account for Dec 02 and this is harming my credit risk score.
Given that the reason I defaulted was that I was out of work and I had paid for PPI should I be able to have this removed from the credit rating or will this have to stay until Dec this year? Also will all trace of it be removed in December?
Also does anyone know if I would still be able to claim the money back that PPI should have covered me for or has it been too long a time?
Any help or advice would be gratefully received.

Yes, the defaulted account will disappear and you will be in the clear as far as bad credit is concerned, it sounds to me you have been messed about and not normally agreeing to people claiming and the good old British compensation culture normally but I would say go and get that money back, you paid a premium for insurance, you are entitled to it.
Hope that you get it sorted and get a copy of your credit reports from all three CRA's and make sure that on day whatever in Dec 2008 that the CRA's remove the bad data if they have not already done so.
