I wish you the best of luck and hope you take it as far as you can go. Are you going after just the buyer, or PayPal too?

They would seem to be complicit in the whole thing; the buyer stole their money, so they stole yours.

As regards paypal, two things. One they moved out of the UK to escape the small claims court in this country. I've seen various postings on websites about going to the financial ombudsman and what you can do, but I'm always a bit sceptical when I don't see many stories from regular posters (on any forum that discusses ebay/paypal) of having pursued this route and had success.

The other factor is that paypal can close or susupend your account at any time and I don't think they'd hesitate to close an account of someone that reported them. I know they're not meant to retaliate, but they're a law unto themselves. I take over 6K a month in paypal, so not having an account would be a bit of an inconvenience, to say the least.

So it'll just be the buyer.

So am I correct in assuming you could NOT issue a County Court summons against paypal in the UK?
I thought the FSA would insist they have a UK office in order to trade here, thus would be answerable in UK courts.
In that case, how could they pursue YOU via debt-collectors or C.C.Summons if say, your account went into the red due to a chargeback months down the line that you totally disputed and refused to pay the negative balance off?
    Something needs clarifying here..

You could possibly serve one against ebay, as they are the owners of paypal.

On the paypal sucks website there are some examples of people who have taken paypal to court in the UK.

However I've in the past scoured the ebay website looking for a geographic address, and never found one, despite it being the law that one should be clearly shown.

    It might have changed now.
