CCCS advice - a couple of questions

Question 1
CCCS advised son to write to all his creditors and offer £1 token payments. Postal orders were suggested but this will be costly for so many.
Question 1
Are there any other options? His bank account is overdrawn so his JSA is now paid by giro. Someone suggested online payments from a bank account but will anyone give him another account with no income?
Also, are court fines included in his token payment offer or are they fixed?
Question 2
Are there any letter templates for token payments that someone can point me to for him to use? I've looked everywhere, I'm sure I've seen an example somewhere but cant find it.
Question 3
CCCS said that judge probably wouldnt allow BR as he is in a "deficit situation" and would like to see "an improvement in his expenses".
Is there anyone here who can explain these statements please?

Get another account - a basic bank account. Co-Op will allow online banking and a debit/cash card, no overdraft (although as with ALL bank accounts you can still go overdrawn by mistake ie direct debits etc). There are lots of other banks that do basic bank accounts, but the Co-Op is one of the few that will allow him to keep the account after bankruptcy (or allow him to open another)
Question 2
Are there any letter templates for token payments that someone can point me to for him to use? I've looked everywhere, I'm sure I've seen an example somewhere but cant find it. Try the National Debtline (link at top of BR forum). They have great templates for almost everything. BUT if he is definately going to go BR, then why pay the £1?? He will need to save for the fees.
Question 3
CCCS said that judge probably wouldnt allow BR as he is in a "deficit situation" and would like to see "an improvement in his expenses".
Is there anyone here who can explain these statements please? This is because the official receiver cannot leave him, at discharge, still insolvent - he would likely be bankrupt again with stricter penalties. Now, this will depend on the amount of the deficit though - £10's of pound could be acceptable but £100's is not.
Post an SOA here on this thread. We can take a look - as we can can trim it a bit for his BR forms to help him be solvent.
Just because he is on JSA though (currently) he still has to pay the bankruptcy fees - £345 (I think), but he would have the court fees waived if he provides proof (recent) of his JSA.0 -
yes what they are saying is even if your son was to go bc he would still be insolvent as he would be unable to support himself financially. If he got a job and then went bc his wage would mean he would not get into the same situation. BC is seen as a fresh start.Question 1

Someone suggested online payments from a bank account but will anyone give him another account with no income?Would be worth him trying co-op or barclays are bc friendly, ask for a basic account.Or could he give someone the cash and then them pay it for him?

Question 2
Are there any letter templates for token payments that someone can point me to for him to use? I've looked everywhere, I'm sure I've seen an example somewhere but cant find it.I used NDL(ww.nationaldebtline.co.uk ),they also do a budget sheet which my OH creditors asked for when we sent his £1 offer.

Ask your creditors to accept a token payment or no payment on your debtsYour addressTo:
Date:
Dear Sir/Madam
Re Account No/Reference No:- 4563210025897412
Since making that above agreement with you, our circumstances have changed.
We cannot now afford to agreed monthly payments because ... [your paragraph added here]
We enclose a Personal Budget sheet which shows our total income from all sources, and the total outgoings of our household. As you can see we have no money left to make offers of payment to my creditors.
In view of our circumstances, would you please accept [no payment/a token payment] at present to be reviewed in six months. If interest or other charges are being added to the account, we would be grateful if you would freeze these so our debt does not increase.
Should my circumstances improve we will contact you again.
Thank you for your assistance. We look forward to hearing from you as soon as possible.

I have just used those templates for my OH 4 creditors and must say no nasty phone calls, just a couple of default letters and one to contact his bank account. So they really are worth doing. Ehmmm sorry to butt into another post so I go bankrupt on the 21st August I will be on Income Support of £60.50p per week
My outgoings
Rent £5.00
CSA £10.00 flat rate £5.00 plus £5.00 off arrears
Court Fine £5.00 per week
This leaves me £40 to live on and I have to pay the £5.00 TV Lic /Elec £10 /and Gas £10
So I have £15.00 per week to buy food and all other essential billls..oops forgot Water Rates £6.00 per week so thats £9.00 per week for food and other bills.....
So is there a borderline possibility that I would still be classed as insolvent at Bankruptcy date.?????????

I have to pay the £5.00 rent as I have a suspended posession order and not to pay that would mean breach of the order or eviction so that will probably be allowed on bankruptcy.
C
SA said I must pay £5.00 per week flat rate to them plus £5.00 arrears or else
I have just had my WTC stopped and been put onto Income Support whilst on sick leave so theres a BIG BIG overpayment looming to be paid back
Where does it all end.. if they stick me with a WTC overpayment charge I most certainly wont have enough money left to meet my basic expenditure after bankruptcy so will they refuse my bankruptcy, so could I be refused on the grounds that I will still be insolvent?
Ive struggled to get my fees together but dont want to be wasting £400 odd pounds if its going to be refused and be in the same position.
This just gets worse and worse..
Anne

Annewitterings - hello and welcome!
Its best to copy everything you have posted here and start your own thread. As you have seen, there are so many and we tend to focus on the new ones (so they don't get left out). But posting on the end of someone elses its likely to be missed.
Nothing is a problem that cannot be solved and it can be in your case!!0
