ripped off by ex and left with c-card debt HELP!

I've had a halifax platinum card for the last 7 years,
there was a direct debit set up from my partners account to cover the expenditure they owed on the account (tho the account was in my name)

Although we split up a while back they quite rightly kept up making igpayements and all was fine.... until last week.
I got a letter telling me I was over my credit limit, it seems the ex has instructed thier bank to reclaim all payments made to the card over the last 5 years!
Halifax have
a. Let this happen and not questioned it
b. Not called or informed me what was going on, just put and extra £5000 onto the balance of the card.:mad:

What can I do!!? Is this legal? Are Halifax liable?
Really worried as this debt will break me!

Please help me!

    Have you contacted Halifax about this? Or looked that the most recent statements (ie. Onlie).

    Banks cannot 'reclaim' payments made to the card. I would say the more obvious thing is that the other person has used the card to some affect.

    Are you the primary card holder? If so, does the ex have a card? If so why have you not deleted him as a secondary card holder?

    You need to find exactly what has happened on the account, but be aware that the primary card holder is solely liable for the debt, so you ex could go on a spending spree and you would be 100% liable for paying for it.

    I think you need to settle this card and get it closed down as soon as possible.

    If the ex was making payments by DD maybe they have asked the bank to claim everything back saying they had been paying in error, the DD guarantee says if an error has been made then you can reclaim :rolleyes:

    The OP has stated that it was his ex that had run up the debt.

    However, unfortunately the law is not on his side because it is always the Primary Cardholder that is liable for 100% of the debt irrespective of who actually ran it up.
