homebase out of stock order

on 27th june i payed for a dining set off HOMEBASE and was told it was delivery only & would take upto 35days which was fine . on the 20th july received a strange letter saying that due to demand it was out off stock but they will be receiving new stock on the 1st july which was 19 days before the letter was sent . so today 7th aug i phoned the company to find out the situation and was told that they still have not had any new stock but even more worrying was that he said because it was in the old catalogue(spring/summer2008) he didnt think they would be getting any more in stock and would have to refund us. any help on where we stand if it is confirmed no more stock available
