Hello,
I am entitled to 24 days paid annual leave each year (8 of these being Bank Holidays).
I am due to have a baby in Feb 2009, and plan to not return to work after the Christmas holiday.
Am I entitled to any annual leave payments whilst on maternity leave?
Many thanks!

You should continue to accrue annual leave whilst on maternity leave. Best speak to the HR department at your workplace. I'm being allowed to take my annual leave immediately after my maternity leave ends.0

I'm also due Feb, and plan to start my mat leave 1st Feb. The annual leave is accrued as normal.
I get 30 days annual leave a year, renewed in December, so i plan to take my 08/09 leave in January, Mat leave Febraury to July incl., SMP August to October incl., then go back in November and get my new entitlement in December for 09/10 - if that makes any sense!!
I think my company mat pay is pretty good, 6 months on full pay, then 3 on SMP, then another 3 on no pay (if anyone could afford to take it).:beer:0 -
yep you will get your hols. my baby was born in may, i took 4 weeks maternity before he was born and 7 weeks holiday before this so stopped work in february (i had a tough pregnancy so took it v easy near the end), I'm taking a full year off and not due back until april 09, but I got made redundant a couple of weeks ago so it doesnt really matter now!DON'T WORRY BE HAPPY

Yes, annual leave continues to accrue whilst on mat leave as others have said. However, your employer is not under any obligation to allow you to front-load annual leave onto mat leave, in that they don't have to give leave until it has been accrued. Sorry, not explaining this very well, what I mean is that if you have 24 days per year and your annual leave years runs jan to december, you "earn" 2 days leave each month as the year progressess & there is no obligation on the employer to let you take all your leave in janaury considering that 22 of the days won't be earnt in jan. Obviously lots of employers will let you do this but they don't have to. Also if you take your full year of annual leave before you have "earnt" it then leave you may (probably will) end up having to pay for leave taken but not accrued.

yes you can take all your holiday in one go, and you wont end up owing your employer any 'unacrrued' days. you are entitled to 12m mat leave, and you are classed as employed for those 12m, so you get your full entitlement. Its a dead cert, your employer knows you are still under their employment for the next 12m, so they dont have to worry about whether you leave mid way through the years entitlement, like a normal worker can, and have to cover the usual 2 days holiday earnt, per month worked

My company gives a days holiday if you have 100% attendance for 6 months... & I got this whilst on maternity leave (pro rata to 1/2 day as I only work part time!!!) Ha Ha!!!

Many thanks to you all :-)
Take care x0 -
As others have said you accrue annual leave even on unpaid mat leave - my HR dept completely ignored this fact, so myself and another colleague went back months before we needed to! (We ended up being paid for some of it, and taking some of it - but we were out childcare costs )The IVF worked;DS born 2006.0
