Claim cheque sent through twice

I made a claim from my insurance and they sent the cheque through to me twice, this was over 7months ago, they have written to me admitting their liability but asking for the money back, where do i stand??

    My mate had this with a health insurance plan they paid out twice, he banked both cheques one in his current account, one on in an isa account, a year later the company still had not come back and asked for the money so he kept it. I'm not saying it was a good thing to do but that was him and not me

    if your insurance company have noticed their mistake and now want the money back I would say they are entitled to it as you have been paid for your claim with one cheque and you knew they had made a mistake in sending two cheques, if you still have it I would give it back

    The money is legally theirs and if necessary they can pursue you through the legal system to recover it.

    If you cannot now repay them, contact them and ask to come to some arrangement to pay them on an instalment scheme.
  • i thought they had a certain amount of time to claim the money back then it was too late?

    You are thinking of the 6 years limitation on using the courts to chase debts.

    Pay it back. Keeping it is theft and insurers WILL prosecute for theft!

    Accidents happen and I am sure you would be the first to phone up an complain if your insurance company made a mistake that was to your detriment, yet you are scrabbling round trying to find a reason why you can keep the money when the error is in your favour. This is not Monopoly you know!!

    The person that sent you the money twice is just that; a person. They are human and entitled to make mistakes. They probably got dragged over the coals for the error in the first place and you are sitting behind your computer trying to find a reason why you should benefit from some poor chap's error.

    Give the money back. An honest person would have returned the money straight away. It's not your money and never has been. Essentially, if you fail to return the money then you are gaining benefit that you are not entitled to. This is otherwise known as FRAUD.

    cot1198, I'm glad your friend is not my friend, because if I knew they had done something like this, they would no longer BE my friend.

    Ok, so this is not murder and I should probably get off my soapbox. The problem is that this attitude of "something for nothing" makes me sick.

    You are a poor, sad, selfish individual if you feel you have a right to keep the money.

    once again I find myself agreeing with you oscar, the mate in question I no longer see for many reasons, one was the fact that he was a compulsive lier who would stitch up his own grandmother if he thought he would make a few quid.
    I work hard for the things I have and even harder to insure them against loss or damage(I'm sure you'll know I'm in the middle of a claim at the moment) and people like this should make every honest person very angry
