Probably because this fee isn't new, and has been in effect for ages. (14th November 2006 to be exact)

For instance there's a thread on these very boards from Dec '06 talking about it

(and as already pointed out a few times, this fee isn't charged if no interest is due, only if 1-49p is due.)

last clause in 7.2 is an incredibly badly worded sentence. obviously they use complex sentences to their advantage, but it definitely backfired on me as i almost canceled by card.
