I have had no reply so I have sent another letter, basically saying that I am disappointed that he has not replied, either in person or through his agent, and so I am left with no decision but to refer it to the courts to settle.

I hope you wrote a proper Letter Before Action making it clear when you would begin court proceedings and he would be liable for all costs plus interest.

People tend to think you are bluffing if you don't use correct terms.

Agreed, my current contract states that the carpets must be cleaned by a company of the agents choosing, despite them not being clean on moving in. There are other clauses which are similarly unfair, including one such as yours stating that utility bill payments need to be proven. I will be sending a copy of the contract to a few people once I am out to see if anything can be done about this.

The only reason that the landlord needs to know that utility bills have been paid is because you can actually change the bills back into the landlord's name or leave the bills in no name, while you live there. This makes the landlord liable for the bills.

I managed to live in a rented house for 2 years where the gas bill was in nobodies name and the gas company (British Gas) didn't complain because the bills where paid on time.

Also you should mention in writing the clauses that are illegal and affect you as soon as there is a problem with them. Otherwise you could easily be shown as being unreasonable.

I suspect the issue was with the letting agent not the landlord.

For some reason I can't get it out of my mind that all letting agents are crooks.

They probably are, and seeing that the landlord had put all the duties over to the letting agent, its probably their fault no inventory was done. Anyways it doesn't matter cos I got my cash back!
