I just wanted to know what my rights are, and in the other peoples defence i think they are only trying to help, this is what the forum is about surely?! x

I believe the garage took the job for the money but should have ref'd elesewhere if busy....

I have tried to advise you on your "rights".

Aside from your rights there is no reason why you shouldn't complain about the service you have received, however that is quite a different matter to the advice I questioned where it was suggested you threaten suing!

BTW - (just thought of another example).
I also got the post office to stop delivering "door to door" junk by threatening legal action.
I'm really not sure whether I'd win the case, but it would have national impact as a test case and it made them change...........................I got what I wanted by being persistant enough in that case too and you usually can if you are willing to be persistant.

What legal action would you take over this matter? (Anyone can fill out the form to get unnamed junk mail stopped - if your local sorting office ignore your request, that is a matter for a complaint, hardly a court case of national concern!)

This example is hardly relevant! (As is your other example on getting your mortgage exit fees waived).

The op asked what his rights were, and your "give them 14 days to pay otherwise court action" didn't advise on his rights at all (and could have resulted in him losing some money had he followed the advice).

Weren't you suggesting a complaining tactic rather than a "right"?

It is poor advice to say yes you can cancel
    Which post is that in?

What I actually said in the sentence you quote from was:
It is poor advice to say yes you can cancel, threaten them with court, and worse advice to say take them to court, they are not fit for purpose!

It was my precis of what you said here:

You could ask for a refund and threaten them with the small claims court if you do not receive your refund with 14 days....The service is not "fit for purpose" in my view

By advising the OP to ask for a refund I took this to mean he would be cancelling the policy.

    Have you actaully tried it?
I have made upwards of 20 complaints and had to make a real nuisance of myself to get them to take action.
At least one of the staff was not of the "calibre" to understand the notice not to deliver door-to-door to my house.
Even though they didn't understand what it meant, they had not questioned it.
That doesn't explain all the failures but does show the calibre of people we are dealing with some of whom can't understand very simply instructions.
if your local sorting office ignore your request, that is a matter for a complaint
Where do you go after you've made 20 complaints? and the staff are still not of the "calibre" to operate the system effectively? (I'm being polite as there may be some quite intelligent and able posties present).
hardly a court case of national concern!
Well actually there are a lot of people who feel quite strongly about "junk" mail.
I don't actually have the time, but some of them are prepared to take action
e.g. retired people with time who stick pre-pard envelopes on breeze blocks in order to cost the sender money.
I haven't got the time for that I'm afraid.
Perhaps if people want to discuss junk mail then start another thread?
I only intended it as an example of a non-financial case I'd won by persistance and threat.
and could have resulted in him losing some money had he followed the advice

I can't see how simply sending a letter would cost money (save the paper, envelope and stamp).
If you do get to the stage of thinking of talking legal action you then take proper legal advice from a proper solicitor but you cannot necessarily do this for every complaint letter.
Weren't you suggesting a complaining tactic rather than a "right"?
    Absolutely, yes !!
Perhaps I should have flagged that so it was obvious.
I never at any point said or implied there was a right to cancel.
I am suggesting that some companies simply "throw in the towel" if you try hard enough (as in the relevant example of mortgage exit fees).
I've won 100% of my financial complaints (about 6 in total), and about 95% of my other complaints. The other 5% involve a mistake on my part and therefore I was fighting a losing battle.

I still think it's a valid contribution (even if slightly off topic from rights).

I do appreciate the need to stay on-topic in fact I am getting a bit fed up with some of the judgmental people around (see the will thread where someone is being judged for wanting an inhertitance).
However that has to be balanced with useful off-topic information (which this is IMO).

I try not to judge and try to be accurate (I have acted on your previous comments) but where I have personal experience that may be useful then I feel it's appropriate to be added..

Perhaps you'd like to continue any personal matters in private?
But you need to empty your mail box.
I've tried pm-ing you before (to thank you) and it was full.

Yes, he would be cancelling the policy and although it's not stated he would then have to replace the cover elsewhere (hopefully an organisation with better service).

I honestly don't believe I implied this was a right.
Simply that you can get companies to do things out of "customer service" although in this case that might be a mis-noma.

I'm sorry if anyone thought I was talking about rights, but I can't see that anywhere.

Didn't realise there were any personal matters involved, so I have none to continue!
Perhaps if people want to discuss junk mail then start another thread?

But it should be pointed out that it was actually you who brought up the subject of junk mail! (As you see, I get it too - my mail box is full of it!)

If you cannot get through to me with your thanks, there is a special button to click on in all my posts you could use as an alternative!

Ah well, I do believe you have some issues with elements of my posting style (and some of it I would accept is justified) but I do believe that's better dealt with off-line rather than cluttering up other people's threads.
But it should be pointed out that it was actually you who brought up the subject of junk mail!

Yes I did, as an example of a case that had been sucessful through complaint and threat. In that sense I do believe it's relevant.
The subject matter is not particularly relevant.
