    hi...
    i am sending the letter off tomorrow to kays , think i missed a call off littlewoods ( iqor passed it back to them ) and dont want to be harrased so do i send a letter to littlewoods about all contact in writing..........

    Hope it is a help to you. I CCA'd NDR (who are littlewoods and Kays dca in June) and it passed the 12+2+30 without a CCA yesterday. YAY!!!

    good luck to you guys. i too am just starting my cca requests and sending them out today, if it wasnt for people like nuf!!!!ter giving us template letters and sound advice I wouldnt know where to begin with this. I too have about 6 catalogue companies after myself all of which i applied for online so never signed anything and all have been passed onto debt collection or solicitors. I just have one question though, when you apply online you tick a box for the terms and conditions which goes through the credit consumer agreements though no-one ever reads the thing i think and I made a phone call to the citizens advice to which i got told if id made payments in the past to it then that started a contract and id have to pay. He was either wrong or misheard my question about getting the debt written off if ive never signed a thing. Any suggestions ....im off to print off some more of these great letters, makes a change me sending out threatening letters to my creditors as apposed to getting them haha i see the light at the end of the tunnel finally thanks you guys for your inspiration xx

    Online is a different thing; you can enter into the contract online and your subsequent actions determine acceptance....

    Don't forget the rules changed recently. All agreements signed after 5th April 2007 will fall under the Consumer Credit Act 2006 regulations rather than the 1974. Just something to be aware of.

    ive had my catalogues going and running smoothly for over 7 years now, unfortunately i dont work ( stay at home mum) and my partner lost his job which threw us into debt which ive never had in my life before all this happened, we just secured our home and other bills first with what we were able to. So after having a good credit and paying ontime I have these companies on my back or their debt collection companies acting on their behalf after me. I just need to clarify that due to me not signing anything whatsoever is there any way of getting these debts wrote off.

    First, a debt is never written off - unless you die and it wasn't a joint debt. The debt may be unenforcable however if either they cannot produce a copy of the CCA or it does not have the required prescribed terms.

    I don't order with catalogues so not too sure about the process of how you would order, but it may depend when you ordered the goods as even sometimes agreeing to vredit over the phone can be the equivalent of you giving consent to their agent to fill in a form on your behalf. With the advent of digital signatures, this gets a bit complicated as to whether you have signed by giving your consent or not.

    Either way, it's still worthwhile requesting a copy of the cca.

    hi all, at the moment have sent the letter stating that debt unenforcable etc , sent it thursday signed for delivery but hasnt arrived yet , do i wait a couple of days or send again but special delivery ? ... also sent same letter to vanquis ( not received yet ) but have had a debt collection letter on behalf of them .so do i send letter to vanquis again ( special delivery ) or get in touch with dca and explain that i am waiting on a credit agreement from vanquis ? help ....
