barclaycard removed money from my bank without authority

Can anyone give me some advice please.

I have an old debt with Barclaycard which is in a queue of creditors that i am slowly working through.

My wages went into my bank yesterday which just covers my rent and the upkeep of my three children and house. £1000. Barclay card have taken from the bank today £884.79?????? I have spoken to the bank tonight and they said they can just do it.

Can anyone give me some advice, i will reaaly appreciate it:confused: thanks ellsbells12

  • As far as I'm aware they all allowed to use the right of offset to reclaim the owed amount, I know this doesn't help much, sorry. Is this the debt cleared in full if not I'd open a different account to have your wages paid into next month otherwise they may do it again.

There is some information about banks/creditors using their right of "set off" in the following link:

  • Had you come to any arrangement with Barclaycard? I'm sort of hoping they have breached some sort of agreement you have previously made so that you can get it back.

I really feel for you, but I am afraid I cannot give you any decent advice, the decent advice will follow I'm sure.
If anything I say starts to make sense, PANIC!

    Hi there

I'm assuming the bank account is also with Barclays. I've heard of this kind of thing happening before and unfortunately I do think they can do it though I'm not sure about whether they need to let you know about it etc beforehand.

Did the bank have any suggestions as to how you are supposed to pay the rent and buy food this month?

I hope you manage to sort something out, it would probably be worth going into your bank tomorrow (with kids in tow) and having it out with them in person. Best of luck

I'm not very good at succinct. Why say something in 10 words when 100 will do?
  • thanks to all
i never thought id see a smile on my face tonight. The bank is Barclays and they have left me with 200 to live on for the rest of the month. I think its theft. The amount they have taken is about half of the debt but not in full precentages, i think they must be paying someone to sit on their backside watching our accounts and saying right, they have something in today, lets swipe it! I could sit on my backside and have a lot more money coming in but i choose to work hard and good my kids a good example - THANKYOU to all so far for replying, i dont feel alone - glad i found this site - x
  • You need to apply for a basic bank account with an unlinked bank, and arrange for next month's salary to be paid into it, otherwise the same thing will happen next month... Please look through Martin's article, 'best current accounts', in particular the basic accounts section.

ellsbells12, banks will often reconsider this sort of thing and take less of you visit them and explain what you're doing to work through your debts. That reassures them that it's not just being ignored. Best to have a realistic budget and agree to include regular payments off the Barclaycard debt as part of your debt clearing so that they see steady progress.

The basic bank account approach is useful if they don't work with you on this. If they do give most of it back, don't transfer account. If you do they will see lower monthly income and will lower their threshold for how much they are comfortable lending you, then become more aggressive as a result.
  • I don't mean to be rude to the previous poster, but you need to ask yourself the question 'can I afford to lose next month's salary as well' There is NOTHING TO STOP barclays doing the same next month, unless you change accounts. Setting up an new unlinked account is usually the advice given by independent debt organisations. You can make payments to pay off your barclays account from your new account without the risk of them taking unforeseen sums.

As you have a current account with them & you're in arrears in the credit card side of their business then they're fully entitled to take that amount to pay off the remaining date (if its past the due date of course).

Your best bet is speaking to someone in collections at Barclaycard & ask to see if they can offer any solutions.

Also the advice about setting up an unlinked bank account is the best advice for the long term anyway.

Best Advice is always to keep any long term debts with a Bank completely separate to which you use for savings or receiving your wages. This is for this exact reason.

SimonGregson is correct. You need to get a new unlinked Bank Account now, and make sure your wages go into that account from now on so that Barclaycard can't their hands on it.

Also speak to Barclaycard and tell them that what they have done does not leave you any funds to live on for the month. They must leave a reasonable amount for your essentials, and if you can demonstrate that they have not done this, then they should refund a proportion of the funds.
