Help - Item won and seller has re-listed it

Please tell me what to do.

I bid and won an item at £10 at 11:46 this morning.

When I returned home I paid immediately by Paypal at 19:00.

The item now says "item is pending payment thru Paypal" I also noticed the seller had re-listed exactly the same item so sent him this message:-

Hi there, Just got in from fishing saw I'd won your rod and reel and paid by Paypal immediately. I know see you've listed an identical item (same wording and photo's etc) on a 24hr listing. Have you another matching rod & reel or have you re-listed the one I bought? Cheers

To which he replied - 'hi there it just i didnt recive a email saying i sold it so i relisted it but i wont 20 pound for it'

Now just rec'd a message and he says ' sorry about that i will send it tomro thanks ' But payment not taken and item still re-listed.

What do I do now ? He could still take my money and re-list. Please advise me what to do ??

If the payment gets taken and you don't get your goods, you will be able to file a non-performing seller complaint and do a paypal chargeback to hopefully get your money back. He may send it yet, though.

Edit: Hang on, I thought I was just being dumb for a moment, but I still can't work out what you mean by the payment not being taken. Did you pay for the item through the ebay checkout? Did you fund it by card? It wasn't an echeque, was it?
  • I went thru the 'pay now' button on 'my E-Bay' page.

I actually paid by Paypal with whom I have an account. I think this went thru my debit card, the details of which Paypal hold. All went thru as per normal. I've bought over 50 items using this process. I have printed off the Paypal receipt for this item. But when I now check the item it is headed:-

A Green tick This item is pending payment through PayPal.

It appears that Paypal have accepted and verified my payment but the seller has not accepted/taken the payment.

I guess he's going to see if he gets a bid on the 24hr re-listing and, if not, accept my payment and send the item to me.

I didn't know a seller could refuse payment and re-list the item. It seems contrary to the Ebay principles

Sounds like he may have a basic paypal account and will need to upgrade to a premier account to accept your payment (and therefore have to start paying fees to paypal as well as ebay). He is obliged to do this, though, so don't take any hassle from him about it.
  • If he doesn't accept my payment and sells the item at a higher price via the 24hr re-listing.

Do I just have to accept it and realise that's how Ebay works???

How then can I stop him taking payment at sometime in the future? Obviously Paypal have earmarked the payment from my account.

You can still report him as a non-performing seller. Ebay seem to be getting tough on people refusing to accept card payments. See this page.

I think it will automatically bounce back to you after a time if it is not accepted, but he will probably reject it soon if he's not planning on sending you the item. If he accepts it at any point and doesn't send the item, then you can file a complaint in ebay and a paypal chargeback as I said in #2, but you ultimately have your card issuer to fall back on for a possible refund as well.

You can't. He has quite a while to accept payment, I can't remember the number of days. But you will be able to do a chargeback if he doesn't get it to you within a week. You must give this guy a negative after you receive item. I am really getting tired of folk messing around. Spent half today chasing up scamsters and screw ups by Amazon. And not a real item sold....grrrrrrrr

Can you do a chargeback on a pending payment? I guess you must be able to, but I wasn't sure.

When I won an item recently I came across this - payment pending. PayPal contacted me a few days later to say the payment had not been claimed by the seller and I was free to cancel my payment at anytime. It did not bounce back - they like holding onto money. Turned out there was nobody at the end of the emails addresses help by PP or Ebay. What a mystery...

The person you're dealing with sounds very confused about the whole system. Makes you wonder what it is he's going to send you when he finally does. Either way he's getting an NPS - from you, or the next peson who wins his item. And the next...

I'm not sure; but in this instance you don't want to do a chargeback until the necessary time has elapsed otherwise seller could claim an NPB. The plus point is the longer it remains unclaimed makes it much more difficult for seller to clear his PayPal account in the event of a chargeback. This guy is looking for any excuse to cancel the transaction, which personally I wouldn't give him.

This is one of the reasons I do not list at 99p start, I always start at minimum I want....OK it results in a lot of unsold.
  • Just to let you know:-

The seller has now withdrawn/closed the re-listing and say's he's posted the item. I am so sceptical now I wonder if it will ever arrive?

But I expect he's got proof of posting

Payment is still pending thru Paypal - perhaps he has to upgrade his Paypal account which may take time.

If it arrives should I neg him or just think he made a silly mistake and won't make the same mistake again ?

Thanks for all your advices - it saved me from 'flying off the handle'
