I think you're overestimating how tricky and involved the whole process is. The agency would have the paperwork to back up their claim, what "evidence" could the OP produce if he challenged it? Easy straightforward case, easily recoverable.
Agree totally. Probably one of the easiest claims that there can be. No defence to it either.

The letting agency staff are unlikely to want to/ be competent to fill in all the forms and "just show up". If it is challenged in any way by the OP, then it would not be simply turning up but they would have to lead a full hearing with evidence etc (which the letting staff won't want to do, even if they filled in the forms themselves) or hire a solicitor to fill in the forms/attend at £200 per hour (as I indicated before).
Any company I have worked for would probably just write it off as uneconomic to recover after asking for it back.
As for the criminal actions, they would have to prove criminal intent, and since the agency paid the money into the bank account through their own stupidity, its hardly the OPs fault. It's also hard to prove without access to his bank records, showing that the monies were not inline with his/her established patterns etc. I could go on, but get real, its not going to happen!

I can see just by reading the OP post that he/she has committed two offences which come under criminal law, deception and false representation.
The bank will give the records of the OP to the Police under the Data Protection act that allows them to gain access to records for an investigation.
Also due to the sum of money, over £1000 it is very highly likely that they will take this matter to the Police.
It is'nt the fact that the letting agents paid in the money, it's the fact that when it was paid in he knew very well that he was'nt due the money or expecting it but still WITHDREW that money, that is the point of the offence being committed.
You may be dishonest, but shut up with your stupid advice when it is clear you know nothing about the advice I have provided.
The op has committed deception and false representation and he needs legal advice.

I think you are the guilty one for not knowing much about the law!
As long as the OP arranges repayment ASAP, he'll have nothing to worry about.
Anything else, would be hard to prove, and hardly in anyones interest in pursuing. As long as they get their money back, thant's all that concerns them.

You are in fact wrong again, you need to start getting your facts correct.
the OP states that he does'nt have ALL the money to pay right again, meaning that they are likely to take legal proceedings with the Police, as that is just like not repaying it.
