They are not jointly liable although, potentially, they have both contributed to the accident.
To be clear. The person whose head onto which the laptop fell did not contribute to the negligence in any way. The person who put the laptop in the locker and the stewardess, are potentially liable. These two are or maybe jointly and severally liable.0 -
Can you explain why they would not be jointly and severally liable?
Yes - joint and several liability means that the liability is equal and that an action could be started against either or both. This does not apply here as any joint liability would be split on the basis of an apportionment of responsibility.0 -

Agreed although there are plenty of warnings about opening overhead lockers - although traditionally after takeoff.
Certainly not severally liable though.0
