    When you say you asked them to prove the debt, just how did you do this? and do you have proof the letters requesting it where sent AND recieved (via recorded delivery for example)

    I have asked them on various occasions both verbally and in the post. I requested CCA and what they sent me was not the full copy, just the back page with a signature on. It gave me no indication of who the original debt was to.

    There is no equity in my property so not sure what they will gain.

    It is not an official letter from the court or anything, just on their normal letterhead.

    As to the original SD, I sent it back Recorded Delivery and asked for proof of the debt, they did not reply so, as per the form, i rang and asked them which was the appropriate court to contact, they demanded full settlement in order to stop action, or an agreement to pay at least £200 per month. i said i couldn't afford it and anyway did not know the debt was mine. This continued for a while until I got fed up. Heard nothing from them again until now.

    Through CCCS I have made arrangements with other creditors, and if I knew for certain about this, they could be added to the list, they'd only get about a fiver a month though.

    Do i just keep on asking for CCA, sending it recorded, so that at least if they do carry it through, I have proof that I have asked?

  • To be enforceable i believe it must contain loan ammount, intrest rate and term, it should also contain two box,s, one for your signiture and one for the finance company, both of which must be signed by the respective partys

    So by your description it doesnt sound like it complys at all, in which case you would have a perfect defence should they try to proceed.

    And if you requested the CCA before they issued the SD, that is null and void anyway as they shouldnt have proceded with that if the account was in dispute anyway.

    In short it does sound as if they are trying to frighten you into paying, but as allready stated, there is no guarentee they wont follow through,but it is highly unlikely.

    Is there any way you can get a scan or photo of what they have sent you and blank out all personaly identifieable info then post it for us to have a look at? it would have to be quite big and clear so we could read it, thats the only way we can be sure we are giving you the correct advice
    Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(
