Moral Ebay Question

This is one to throw in for discussion.

A friend asked me what would I do in her position, so this is what happened.

She ordered 3 x new ds lite games from a seller, the seller said the games were UK games, new and sealed. She paid by paypal, got charged £12.00 in postage, when the postage came to £3.00, no padded envelope, just normal brown one.

When she opened the package the games were American ones, not sealed properly, she contacted the seller, via ebay messageing and there email address which incidently was a Hong Kong email address.

The seller said send them back, and I will refund you only the cost of the discs minus 25% restocking fee, meaning she would of been way of of pocket.

Reported to ebay as not being UK goods, 10 days later the seller never replied to ebay, she then escalated the compliant to paypal, 10 days later the seller still does not replt to paypal. Paypal conclude the dispute, and find in favour of my friend and refunded her in full. I have seen all the emails and at no point as paypal said she has to send the discs back.

Now the seller is getting arsy and threatening her, calling her a thief, that she has exploited them through legal loopholes, she has rang ebay they checked the account and said she was in the right, but this seller is becoming a pain, they all all her name and address. Shes a single mum, trying to get presents ready for xmas when she can.

Should she return the discs to the seller as he wants, or keep them as paypal have refunded her in full without the discs going back?

    Personally..
    I would think i would be well within my right to keep them after the lies and hassle!
    But, if i was going to be nagged none stop about them from the seller, based upon the fact she did get a refund; probably just send them back.

    Maybe she should ask him to pay postage as she is going out of her way for him!:P

    If she can put up with the hassle, then why not keep them!

    Just my thoughts :D

    In this case, if the items were not remotely as described (NTSC and not sealed) I would ask them to cover the cost of returning the goods and then send them back.
  • Send them back in the envelope they came in with the sellers address on and stick it in a post box that way you and your friend will have a clear consiouns, Then if and when he gets it back he will have to pay the postage if he dosn't get it back at least you will know you posted it like he wants you to.:rolleyes:

    the games (assuming they're not faulty/damaged) would work, Gameboy games are not NTSC/PAL differentiated or region coded

    but the fact remains that the goods were misleadingly described & not in the condition promised

    I agree with the above, ask the seller for a pre paid envelope in which to return the items.
