can anyone help - driving test appeal

Hi - Don't know if anyone has advice for my son who recently had his driving test stopped because he had a puncture. He was in a driving school car and has learned today that a puncture is regarded by Driving Standarda Agency as a mechanical failure . This means he has forfeit his fee. I can't find anything anywhere about anyone who has had a puncture on a driving test - it seems to be pretty rare - do you think it is worth asking the instructor to support us in a second appeal?

Surely it's up to the instructor to make sure his car is roadworthy for the test, so imo he should pay for your son's test fee.Have a look on www.2pass.co.uk there's loads of instructors on there who might be able to help;)"You can't stop the waves, but you can learn to surf"

Yes, it's up to the instructor.
The fact is that these things happen. The DSA have no control over it so they cannot be expected to refund for it.
The instructor doesn't really need to refund you as it is not really something that they caused (unless the tyre was previously damaged - not easy to find out) so they won't be obliged to pay anything.
Sorry, but this really is a situation beyond anyone's control.0 -
What is there to appeal against? It had a mechanical failure. The rules are clear.0

I'd see if you can get the instructor to see if he would go halfers on the retest fee as a goodwill jesture0

how can the instructor be held responsible for the car picking up a nail(ETC ETC) .... ? its like out of any ones control or we could blame the local council for not picking up the cause of the puncture . ADI,s don't make enough cash as it is , fuel costs are not to good at the moment .22864 quid and counting , but now proud to be dealing with it :j

As others have said, there is nothing to appeal against, I would have thought that any decent driving school would have paid for another test for you, but they are not obliged to.
Just one of those unfortunate things.0 -

Perhaps there is an argument from a moral/ ethical perspective, factor in the potential loss of reputation as well for being intransigent!Don’t be a can’t, be a can.0
