Why did you apply if you already knew that they would reject you though? There are plenty of circumstances in which they would reject an application - I don't think that the Halifax need to list them on the Mortgage offer, particuarly when some of the circumstances might've been okay with them before the 'credit crunch' changed their lending criteria.
If they know that they wont give it there should be no mention of it. As for the Credit Crunch - thats absolute rubbish...0 -

My point was more general than about your issue, but more about other circumstances. You can't expect the Halifax to write a list of caveats about who they allow to have a payment holiday as it will change according to the individual's circumstances at the time, and the Halifax's only lending criteria. They allow people to apply - that doesn't mean that they're saying you fit their criteria.0 -

There is already too much paperwork and its far simpler and more common sense not to list reasons which may or may not be an issue when the time comes.Do you not think its a little dodgy that they say I can apply, when I cant?
You did apply and they considered your application and rejected it. So saying your cannot apply would not be correct.

So as Silvercar said, the offer should say "dont bother applying because we know you have a 2nd charge so youre not having a payment hol" - or at least, not mention any payment holiday at all.
It does say this. In your mortgage terms and conditions that was sent to you at the start of the mortgage:-
"Information about your mortgage" Item number 1/9201100-6

Section 15 - Payment Holidays
"This section does not apply yo mortgages with fleixible options that have seperate arrangements.
As lon as your account is no more than one month in arrears and your mortgage is at least six months old, you can apply for a payment holiday, providing:
>no payment arrangementss have been made in the last six months
>the total outstanding debt doesnt excess the maximum lending limit for the type of loan
>no second mortgage or subsequent charge has been registered from another lender
>you are not currently claiming on mortgage repayments insurance policies
>where you already have a halifax homeowner loan secured on your property, the projected mortgage debt plus the amount due under the homeowner loan is no more than 97% of our indexed valuation of the property."
