car tax penalty (but not owner) - Advice please

I purchase a car from a garage which was subsequently returned as beyond repair after a short period of time. I returned the paperwork and request for refund of the tax that we purchased for the year. I received a cheque for the tax refund and thought no more of it. Some months later i have now received a penalty notice as the car hs notbeen taxed. I have been in communication with the DVLA who just state thati need to pay it. I have duplicate documentation and but they are not interested and reitterate just pay of the fine will double. If i owed this i would pay it but feel like i am being ripped off as an easy target. Any advice please???

Have you got a copy of the slip which shows it was transferred to the motor trade, part of the V5?

Send them a copy of that

What do you mean you have duplicate documentation?

Did you ever get a V5 in your name?
Did you get it before or after returning the car to the trader
When you returned the car to the trader did you send off section 9 from your V5?
Date car was returned to trader? (important)
Date tax was due?/liability date should say in fine from DVLA.

There is a school of thought on this that if you just ignore the charge, they will not sue for the debt, but the risks are
Debt collectors come calling for the debt (you don't have to pay them)
The amount rises to £80 and then will rise again as the debt progresses in time.
You may be taken to court
The debt lasts for 6 years - if nothing happens by then the debt is cancelled.

If you didn't send off the V5 to notify change of owner or ensure that the garage sent off the yellow part, you're still classed as the registered keeper.
