Ripped off on holiday - advice needed!

The emails mentioned that the group size might change by 2 or 3. They went from 3 guides to 0 guides, and then after some moaning 1 guide for 50% of the time.0

I am puzzled by the legal advice given. I am not a lawyer, but it would be very hard for them to demonstrate that they had complied with the agreement (contract) into which they had entered. I would be worried if a company could get away with this kind of behaviour by relying on "secret" terms and conditions.
Possibly the key factor is whether or not any case against them were to heard in a full court or under the small claims procedure. In a small claims court, I would imagine that the judge would be less than impressed if they relied on T &Cs that they had not given you, and would agree that their email demonstrated that you had a reasonable expectation of the guiding services. In a full court hearing, technicalities such as the precise wording of the T &Cs would have more impact.
I hope that the friendly solicitor above will return to comment on this thought.0 -
Hmmm, interesting. Sturll - what do you think?
I'm of the opinion that complaining to their trade body (mentioned above) is probably the way to go initially; they offer an arbitration service.0
