Car Write Off - Problems with Salvage Company
Basically my car has been written off but I had also agreed with the insurance company to have my car returned to me (free of charge) as it's worth more to me than what they were offering so was surprised to be able to have the car back and receive the insurance money so with that we could do the repairs and get it VICed and MOTed to get it back on the road, unfortunately on phoning the garage to pick the car up we found out the salvage company had already taken the car, last week the salvage company contacted me by letter to get in touch to have the car returned which I did and they never phoned back, so phoned again today and they said that they would phone back within 10 mins, after waiting 4 hours they finally phoned to tell me they have damaged the car further when loading the car to bring it back to me and now it is definately not repairable and they have offered me another car - same make and model, few years younger, same features nearly but it is a Cat C write off that needs repairing (they are coming back to me with what repairs are needed) and the mileage is 80000 and mine was 44000 and only needed a new front bumper and indicator light to pass new MOT and have the VIC done on it. But so far they haven't come back to me with the state of this other car nor would they tell me what other damage they had done to my car, OH thinks we should go and have a look at my car to see what damage they have done to it and also look at this other car as well, he seems to think that they may have already done the repairs to my car and they are fobbing me off saying that they have damaged it further as the repairs were quite straight forward. I definately don't want to accept another car without seeing it first and where do I stand seeing they have damaged my car further.

Arrange to collect the car from the salvage agents asap. It is still your property so they cannot deny your right to do this. Then see what damage has been done (if any) and then - assuming the salvage agents were instructed by your insurer - raise the issue with your insurer.0

Its quite simple. The car belongs to you, not them. You want it back, they must give it back. If they have damaged it, they must pay for all repairs.
If they don't like that, tough. That's what the courts are for.0 -
Hi Janedoe, I tend to agree with your OH I'd check out the state of your car,also just wanted to say I know what your going through, I've had a similar situation, I recently had my car written off through no fault of my own, but managed to keep it and get insurance money, I am taking it to have the VIC check 2moro, but can not believe what hassel this whole experience has been. Just wanted to say I sympathise with you! :grouphug:0

They cant keep your car or offer you an exchange they are trying to pull the wool over your eyes. Your car is obviously worth more than the Cat c right off. Tell them you are going to come and view your car and arrange for it to be collected. Could you speak to the insurance company to put pressure on them? Also people who scrap cars must be registered as a motor salvage operator with the local council. I would enquire to make sure they are registered and everything is above board.0

I spoke to OH yesteday and he said not to accept anything they are offering and need to see the damage or at least photo's as he is away with work till today but can't get time off till friday afters and go have a look then, I'm not taking ant offers0
