Filing for BR, but cant get creditor list from IVA

Hi everyone.

My IVA is to fail on 5th August, and all creditors are free to do as they please with me, according to my IVA supervisor.

I am filling in the BR forms online, and all is complete aprt from what i owe my creditors. It has been two years since my IVA started and i have no records of what they have paid them or even what the account numbers are anymore.

I rang them and they said they will call me back because they are busy. Im strongly thinking that they wont tell me until it fails, then i will have balliffs at my door!!

How can i get this information? Can i ring the creditors direct or something?

    Hi Hughie,

    Can you remember roughly what they were before you started your IVA? TBH they won't have gone down that much in 2 years as the IVA company pay themselves first. The OR will write to all the creditors asking for the exact amounts. You can ring the creditors yourself, if you feel up to it.

    As for bailiffs, they can't trouble you unless you have CCJ's that you've defaulted on. Even if your creditors apply for CCJ's now it will be a fair while before it gets to the bailiff stage, by which time you'll be bankrupt.

    Thanks peachy, its nice to know that the balliffs wont be here so quick.

    I can probably find out the amounts i owed originally. I just dont want to write things down that are not correct, but as you say, it wont have changed much.

    Ive read up on BR lots over the last year. I was going to do it, then i wasnt, but now i have too and im glad about it.

    Can you just confirm that i have to fill out the forms online, print them off and take them to the court with the BR fees. Then they will take the forms, money, and set a date for the hearing? Id like to get the date set as soon as possible.

    Either fill the forms in online here
    https://www.insolvencydirect.gov.uk/isolv/

    or phone your local court & ask for the personal insolvency dept they can send you forms in the post....you would have to contact the court first to see what they do some courts offer appts some walk in service...once you find out then fill in the forms & take 3 copies to court on the appt they give you....

    You can phone the court now and ask how long you will have to wait for an appointment, some courts you'll be able to just turn up, others you have an appointment but it can be anything from a few days to weeks.

    At the majority of courts you turn up on the day with your forms and money and are declared bankrupt the same day, There are a few where you have to go back the following day to collect your bankruptcy order. When you phone for your appointment they will be able to tell you how they operate at your court.

    Ive found out my old IVA proposal which has all my creditors account numbers and amounts, so i can get the forms completed now.

    You say to take 3 copies. Is that 3 copies of the sheets im filling out online yes? Im sure i knew this before but ive forgotton all the finer points at the moment.

    Now im going to ring my local court :)

    Yep three copies of the forms you print off...one for your records..one for the court...and one for the official receiver

    I just rang the court and they do same day appointments on tues,weds and thursdays.

    Ill let you know how i get on, going there next week.

    I had the same problem when i found out that mine would fail. I ended up telling them that i had an appointment at court for BR and i would mention to the Judge that they had failed to return my paperwork and suddenly they were able to fax me it.
