me again lol, just in case anyone was keeping track. I have now had a letter back from the cab lady, enclosing the reply she got from the council.
they claim the money is still recoverable and make 4 points
1. that I didn't tell them of any changes in april 2007. -there hadn't been any at that point
2. the overpayment was due to an ommision on their part but they can recover it from me -everything I have been told suggests if it is a mistake on their part it can be waived.
3. I should have worked it out on the breakdowns. -this I agree with, as I didn't sit down and work out our weekly net income to check it matched, I just saw the amount they pay us had gone down and assumed it was due to the changes I had told them.
4. Part of the overpayment is from the 2008 change. -this I am totally happy to pay back, despite having rung them the day after dh's payrise in april to tell them, and telling them I couldn't provide an accurate payslip till late june, they didn't adjust till they got the payslip. I also didn't know it would take us over an entitelment threshold to getting nothing and owing them the money as from entitled-to it looked like it would just go down to a lower amount.
So, rung the lovely lady, she is away so had to try an explain to another busy lady and she is going to advance the appeal to the next stage. Part of me wants to talk to the council direct but it seems safer going through the cab at the mo.0 -
and finally. got the £1910 written off notice today, so paying back the secondary bit which is fine!
