Saying they are exempt from minimum wage rules is misleading and would suggest that on a bad week for tips a waitress may get paid £1 per hour, this is simply not true, she would get paid her normal wage, it's just a question of where the cash came from.

This is true and many people do not tip, however, a lot of people do. I think the company should have to state somewhere that the staff do not get the tips on top of their wages but that they actually make up part of their wages - if this was known, I very much doubt anyone would tip.

What if all the wages are paid (using tips) and there is still some tip money left over> Does that then go to the staff or to the company as profit?

When I used to work at a restaurant and was asked if I kept the service charge (different to tips where I worked as it was only charged for large parties) or tips paid via credit card (not cash) I would tell them no I didnt' (this really p*ssed my manager off :rotfl:) but I think I remember reading that an employee at a well known chain did the same thing and got fired!

I think it's a great idea to name and shame all the restaurants who use this method of topping up the wages with tips!

Perhaps we should have 3 catagories:

    1) Restaurants who use the tips to top the wages up to the minimum wage
    2) Restaurants who pool the tips and share them out
    3) Restaurants who let you keep the tips that you earn from the tables you serve.

Pizza Express is a catagory 3, and the waitresses/waiters keep their own tips that they personally make, on top of their salary. I know many happy Pizza Express employees
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
