hi i contatced him again
i said to wait a few days only until i hear back from royal mail via email or telephone
i know the buyer has dropped the item, but i cant do anything aout that, so i said to wait and then said the goods back to us
if paypal do a full refund, then i wont be too happy, but what can i do in a situation where its my word against his?
also if he does get a full refund, then hopefully RM give me full compo?? and at the same time i can even sell the laptop on again....0 -
Thats the problem, did RM damage it, did he damage it, is it even actually damaged? Did he receive it and think "Oh, thats not what I wanted, I'll get my money back"? Or is it a deliberate attempt at scamming you?
From the way I'm looking at it, you're going to end up refunding him anyway. So let him go through PayPal on the chance that they side with you and not him, therefore no refund to pay, no return postage to pay. If they side with him, he does have to return it and they won't transfer the refund to him until he can prove you've received it with online tracking, which is also better for you. The only slight worry I'd have with the buyer starting a paypal chargeback at this stage is that by the time royal mail investigate their claim, the buyer may have already won the case and might then not cooperate in the RM investigation (depends how quick RM are to look into it, of course). I don't know how RM will treat a claim for such a high-value item, but I think they will at least want to satisfy themselves that it was packaged adequately, which can only be proven with the help of the recipient.0

then we might not get a full claim back
meaning also the buyer has a possible full working laptop???
and regarding the RM claim, does RM not also contatc the buyer??? as he will have the laptop and maybe fill out a few forms??0 -
oh unsure if i mentioned it above, but he has started a dispute and paypal have frozen the funds at the moment

Yes all funds into your paypal account will be frozen while the dispute continues.
Now that your buyer has started a dispute you will have to let it run its course, just respond in a timely manner to all questions raised by paypal, keep it clear and concise. At any time you can stop the chargeback and offer a refund and if you do that I don't believe that paypal will mark your account with a warning, if the dispute continues and you lose then you will get a mark on your account.
There is a chance that your buyer may have to co operate with your RM claim, it seems fairly usual for the RM to require sight of the packaging. However, you will still be out of pocket even if the RM find in your favour as they only pay the item cost, not the post and packing element of the ebay invoice which you will need to submit to prove 'loss'.
Be polite to your buyer and try to keep him happy, even whilst the dispute continues. He would be extremely foolish to stop the chargeback now as he would never be able to restart it, so don't bother trying to persuade him to call it off.

OK Dispute is still contiunuing
paypal are awating my response, i have until 2nd no to reply
buy unsure of what to say, cos i can easily refund him
however after contacting royal mail
they replied saying they need for me to send them the laptop?? which i thought was definitely unusual???
what shall i do??0 -
You must respond to the chargeback otherwise you will lose it by default. You must now make a decision as to whether to fight the chargeback and risk losing not only your paypal payments but also the RM chargeback if the buyer is slow to return the laptop to you. Or agree to fully refund the buyer as soon as he returns the laptop to you.
