    he told me that i have to pay it all within 3 weeks this was 2 weeks ago. tho i was told i could pay in instalments, mine and his difination of installements is diferent. ie he want it in 3 weeks no matter how many times i send payment. i thought i could pay monthly.. obviously not!

    my solicitor also stated that due to people not paying when cases are over they no longer do installments !!
    Surely me not paying my solicitor on the 31st the day were back in court is a bad thing.. i know i plan on going BR the week after.. but would it really be included in BR ??
    I dont really want to get on the wrong side of a solicitor!

    Seems your between a rock and a hard place when it comes to paying the Solicitor. If you do you might get slapped with a BRO/U if you dont you wont have the legal advice you need!!!!! Maybe CAB could advise on the legal wranglings you have going on???

    Also if you are insolvent wouldnt you qualify for Legal aid? Isnt it means tested (Income expenditure)??

    Hi debt23 and welcome :)

    Right, firstly - are you still receiving the services of the solicitor? As in, if you don't pay him then I assume he won't represent you any more? If so, how much longer will you be needing him for?

    I agree with shadowdragon - I'd rather annoy your solicitor than the OR..... honestly.

    This bill counts as a debt and ALL debts should be included in your BR. As you've been told above, showing preferential treatment to a creditor is looked on VERY unfavourably by the OR.

    Re your car - I assume you've already tried the free/cheap ads in your local papers?

    Lastly - don't panic, we will help you all we can :)

    Bankruptcy Restriction Order / Undertaking.

    Basically, it's like a 'punishment' for those who have:
    Run up their debts due to gambling or reckless spending (ie taking on more debt when you KNEW you were insolvent)
    Not co-operated with the OR/Insolvency Service.

    I would deffo go see the CAB about it, I dont know much about Legal Aid ect, but if the solicitor would get more £££ charging you than if you used the Legal Aid system, maybe he was telling fibs? I would ask for a "Second "impartial" Opinion" if I was you.

    Hi i spoke to CCCS and they also say to get a roof over my head and the sol fee will go under BR.. my onlu concern with this is.. my solicitor wil be funny with me tho he may refuse to help me in court i could get a duty solicitor for free.
    my concern is... he has all my details he wont hand them over without getting paid !!
    aggh such a mess :(

    Hi D23,

    Can you not give a rubber cheque on the day he represents you.

    Would'nt pay the mortgage and would empty your account of any credit balance.

    Set up a CashMinder account with the Co-op

    and as Shadow suggests give CAB a call.

    Keep your rent up to date you will need to keep your LL sweet.
