IM In Such a MESS :(

Im due to go BR on 6th august my fee of £495 was to be taken from the sale on my car.. ( i put it on ebay to sell quick and alot less than book value) to get messed about, i have today relisted it in hope i sell before end of month.
also i have £400 bond and £345 rent that was also taken from the sale of car , im due to pay the £745 on 31st july, so i can go BR in rented acc , i have a 28 suspended repossession order on my house, i wanted to be out of here by the payment due date of 1st august ! handing keys back under BR. now im unable to pay deposit for bond which means im stuck here with no mortgage payment.
i have had welcome turning up 3 times a week due to secured loan not being paid this month !
i get paid £1100 on 31st july to which i HAVE to pay my solicitor his £900 fees ( FAMILY PROBLEM I NEED LEGAL TEAM- TO WHICH I CANT EVEN AFFORD) NOT ENTITLED TO LEGAL AID EITHER . not my fault . i have no choice but to get legal rep. needless to say i no longer have a family since they dragged me in their mess.
so minus 900 i dont have my BR fee or anything. so i have £200 left.
So now i cant go BR or move into rent unless i sell my car before 1st august. !!
2 people bought my car on ebay n both messed me about :(
i owe money left right and center and have them knocking on door. i wanted to be in rent and then BR so al this can go away.. looks like i have another 4 weeks of it. :( so while im here waiting for next months wage i still have welcome chasing me/sat outside my house. mortgage will go for repossession before i go BR and other debt letters and phone calls on top of all this.
I just want to run and cry and never stop :(

    hi Debt
    I have missed 2 payments on secured loan and 4 on mortgage! OR suggests I may wish to await repossession. The amounts I would have to pay exceed my income!!!!!

    Someone with experience of how long this takes will be along shortly

    To get all the DCAs etc off your back and give you some breathing space you can write to them and state that you only wish to be contacted in writing and any other contact will be construed as harrassment and reported to trading standards as such - there is a letter somewhere on the Debt board for it - I'll try and find it for you (give me a min).
    That does mean you have to dialogue with them though, so also put in the letter an offer of £1 a month or something - this should give you enough time to sort out the BR fees.

    BTW - by paying off the legal fees right before BR you could be seen as favouring a creditor with preferential treatment, which the OR is really really not fond of, so I would strongly advise (imho) against paying this, but including it in your BR or you may get into hot water once your OR starts investigating you. I would use that money instead to pay the rent bond etc and BR fees and include the legal fees in your BR. If legal fees are one the very few things not included in BR then obviously this might be different, but I think you need to a) call one of the agencies (CSSS/CAB/Debtline etc) to get advice on that and b) take a big breathe and think about things a little clearer - your soliticors can't do anything to you once BR - if you don't pay them they will only (eventually if at all) make you BR - you no longer get sent to prison for not paying debts and therefore if you have already gone BR this is no longer an issue. Whilst I feel for the lawyers, you have to look after number one sometimes (and I think they make enough to not worry too much about loosing one client's money).

    OK, the letters - send the first one recorded delivery (so you have proof it got there). If they continue to harrass you, then send the second recorded delivery and phone trading standards. good luck.

    surely i cannot refuse to pay legal fees? they are representing my in a family problem and nothing to do with money!?!? if i dont pay him his money he wont help me in court !
    ( im no criminal, lol just a very horrible family situation i need legal help with)

    Great idea of Pixies. Also once you go BR you can hold off Welcome for a few more weeks, tell them your bank account has been frozen due to BR so you can't get any money until it's unfrozen;)

    Is the car on ebay now? Do you have any watchers, and have you got a buy it now price?

    i put the car back on ebay last night.. to which i still cannot find it when im searching. ebay have messaged me back saying it can take 24 hours.. complete JOKE. i have buy it now, reduced and offers. i just want a quick sale yet people cant view it as its not showing when searching :(

    In my experience you get a bill at the end of the legal services - admittedly this wasn't going to court, this was just some advice and letter writing, but we got the bill/invoice only when the lawyer/solicitor (not very good with the offical names, sorry) had finished doing everything he was doing for us. Therefore you just don't pay it.

    I wasn't suggesting you were a criminal in any way nor that the legal issue is to do with money - but you should get a better lawyer if he is asking for the money up front, as that is very very dodgy (so is knowing you are not going to pay him I guess, but there you go, swings and roundabouts, and this isn;t about the rights and wrongs of such things, it's about you going BR and getting told off/BRU/O/the solitior having to give the money back anyway and you getting in right royal trouble from the OR if you do pay him - can I clarify - have you already had work done for you by the solitior that you owe him money for? If so, I am guessing that is a debt and therefore counted the same as cc debts etc and therefore you shouldn't pay it according to the OR. Get advice from one of the agencies, as you should be able to go into more specifics with them about your case and they should be able to advise you.
