Distance Selling Regulations - Teletext Holidays?

Someone I work with is having a nightmare with a holiday she's just booked and I'd be grateful for any advice people can offer.

She booked a package holiday on Monday night through teletext holidays - it was a deal she saw online but ultimately booked over the phone.
Unfortunately her friend (who she is going on hol with) has now been told by her boss that she can't have the time off, in fact she'll lose her job over it if push comes to shove!

I have a limited understanding of Distance Selling Regulations and believe they would apply to holidays booked over t'internet or by phone. However, this was not mentioned as an option when she spoke to teletext hols to explain the situation.

Any advice gratefully received.

    I should have mentioned also that the holiday is not until early September - I'd imagine that Distance Selling Regs would go out of the window on say, last minute bookings?

    I hate to point out the obvious but I don't think she has a chance of getting her money back especially if it is within 12 weeks. Why on earth did the friend not check with the other friend before booking?
    Did she pay in full?
    Can she change the name to someone else that she can take?
    I don't know anything about distance selling regs and am sure someone will be along soon more knowledgeable.

  • are u sure it may difer if it was on telephone as i cancelled a hotel under distane regulatioons no problem

    "2) Regulations 7 to 19(1) shall not apply to -
      (a) contracts for the supply of food, beverages or other goods intended for everyday consumption supplied to the consumer's residence or to his workplace by regular roundsmen; or (b) contracts for the provision of accommodation, transport, catering or leisure services, where the supplier undertakes, when the contract is concluded, to provide these services on a specific date or within a specific period.
    (3) Regulations 19(2) to (8) and 20 do not apply to a contract for a "package" within the meaning of the Package Travel, Package Holidays and Package Tours Regulations 1992URL="http://www.opsi.gov.uk/si/si2000/20002334.htm#note9"]9[/URL which is sold or offered for sale in the territory of the Member States."

    Don't like the sound of the boss, she's given plenty of notice.
