  • Hi just thought I'd post an update as to whats happening....

    Spoke to National debtline this morning. They said my student loan is one of the 'old' type i.e taken out before the laws changed in 1998. My student loan goes back to 1995. The CCJ thats on the debt could also be questionable. They also said that you could almost guarantee MH have purchased the debt as the SLC have probably written it off otherwise they would have took it back to court themselves to get payment.

    NDL advice was to never speak to them on the phone, ignore their calls and don't ring them, just wait for written demands from MH (I've only had one from telephone at present) then hit them with the Statute Barred letter. MH are probably not aware theres a CCJ on the debt though if I told them, then MH may wish to take it back to court but theres a chance the judge wouldnt rule in their favour so they probably wouldn't bother. If however they did, then I would have to apply to court to have the CCJ 'set aside' and therefore give me more oppportunity to get it statute barred. The SLC would also have to give answers as to why they haven't pursued payment better.

    The NDL couldn't give a definate answer but theres a decent chance I won't need to repay this one. If however my student loan was taken out after the change in 1998 then they play by a different set of rules and would already have been back before the courts before now.


    So its just a waiting game I guess now to see if one of the MH postcards drops through the letterbox (I've no doubt it will) before I send them the Statute barred letter. The NDL were really nice and very helpful so if anyones in a similar prediciment then just give them a call.

    Thanks aswell to all those on here who have posted I'm much appreciated and I'll keep this thread up to date with how things are going incase others have a similar problem. :cool:

  • Thanks...got to admit its a weight off my mind. I'm lucky that the student loan was pre 1998 otherwise things may be different. You're right though i think it will fall in my favour....in time (well thats the view of NDL anyway and they filled me with more confidence and assurance that I didn't have before) and the ball will soon be back in MH's court

  • Hello to all, and many thanks for all the info on the above company. Special thanks to Rog2.
    I've just received a letter from them. I was in a terrible mess 7 to 8 years ago, my ex husband had got us into loads of debt and I buried my head and ran away from it all. I have paid 2 debts off that found me, I don't honestly know what else there was but I remember seeing a letter that said CCJ in the window, I never opened it. I've worked really hard to get my credit back and a recent look at Experian shows its all good for past six years. Can MH mess all this up for me now? Am I best ignoring this letter totally (it,s the standard looking for re personal matter from Andrew Lowe) or sending the not ackowledging debt template?

    All help appreciated, thanks guys:confused:

    Hi cassandra - It IS, indeed, possible that MH are raking up a debt from 6-8 years ago, and that this 'debt' is probably so 'statute barred' that it should be in a museum.
    For the moment, and until they become more specific in their requests, I would be inclined to ignore them. Don't worry about 'offending them' - they are impervious to offence - if they are sure of their case, then they should be specific in their letter.
    Check the registry trust website for details of any outstanding CCJ's - http://www.registry-trust.org.uk and don't wory unduly if this does throw up a CCJ that is over six years old. MH would need to go to Court, for permission to 'ebforce' it, and have a pretty good reason as to why they had done nothing about it for the past six years.
    IF they continue to contact you, you could send them the 'prove-it' letter (link in previous post).

    Will ignore the pond life scum as previously described! Just concerned that there might be bad comeback to my credit history and also to my address, as I live with a friend I don't want them blacklisting or hassling. Do MH have any power to do either of the above? :eek:

    ...erm they aren't. I've had numerous texts from MH and 3 calls (which I didn't bother to answer). And thats it, not even a letter from these clowns, not even a silly postcard, not anything. I've had absolutley nothing at all in writing from these time wasters. I was advised by NDL to write to them should they write to me but as yet I've received diddly squat.

    Any thoughts??

    Have you sent the letter about harrassment by phone that i posted?

    If not you could send that.
    Otherwise you could either ignore the calls as you currently are or you could jsut write to them stating that the debt is statute barred and that you will not be making ayments towards it (template letter also in that linked thread)

    Just stick to your guns, tt - MH always prefer to telephone as there is only a miniscule chance that 'debtors' record their phone calls, whereas letters are acceptable forms of evidence.
    As George says - send them, recorded, the 'harrassment' letter - keep copies of ALL correspondence between you and these 'creatures from hell'.
    As we have said before - if MH feel that they have a genuine case they will, eventually, write.
