    I've not had chance to see my credit file yet (will be doing so once I get home from work). And yep, will be seeking some advice from the national debtline before I plan my next move. I have no intention of entering into any agreement with MH at this stage until I find out my position. MH haven't even wrote to me yet, all they've done so far is call me with an arsey attitude and god knows how they got my mobile number.

    If arsey attitude on mobile continues after doing whatever NDL suggests, i advise sending the following anti-arsey letter

  • Hi there can anyone help me..

    I've had a call from Mackenzie Hall regarding an outstanding debt of £3k which was from the Student Loans Company. Theres a CCJ on the debt but that was from 6 years ago. I've not paid any money towards the debt since it had a CCJ for the simple reason the Student Loans Company never came chasing me for it.

    Now I get this call from Mackenzie Hall...luckily I was driving at the time and I told the guy this and he'd said he'd ring back, which he didn't.

    Is the CCJ still enforcable after this time? If so why didn't the Student Loans Company just re-enforce it? instead of passing it on

    I've had a quick look at other threads concerning Mackenzie Hall and it seems they are a dodgy lot to say the least and they also specialise in old debts that have become statute barred.

    Would my debt have become statute barred? and is it still enforcable?

    If anyone can help I'd be really appreciated

    Ok i'm really confused now. i've checked my credit report and its clean as a whistle, no CCJ's on there. So where do I stand now? Is this debt still there? Are MH clutching at straws and hoping to bully me into paying up?

    I'm so confused...can anybody help?

    It may be that 6 years have elapsed since they got the CCJ. If this is the case then the company will need to apply to the court to enforce the debt - but the CCJ will still exist. It's just fallen off the credit report as it's been more than 6 years. They will probably also need to explain to the judge why no effort has been made to collect the debt in that time.

    I'd call national debtline for advice on this. The link in post 2 should help explain it a little.

    Note - not all debt are held by each CRA. The debt may be on one of the other CRA's. For information on the CCJ though, you sh be able to get info from here.http://www.registry-trust.org.uk/

    I'll be ringing national debtline at 9am in morning for further advice. What do you think my chances of be made to pay up are? Are MH likely to take this back to court?

    I'm afraid i've no idea, but it would be helpful if you let us know what ND says about it. There would need to be a good reason for them not collecting the debt within the last 6 years, but i'm not sure if because it is a Student loan that they may treat it slightly differently.

    Hi tt - even a CCJ will 'disappear' from your credit file after six years - whether satisfied or not.
    That said, it is highly probable that MH are, indeed, clutching at straws. Either way, it is up to them (MH) to prove that you owe this 'debt' and they must give you irrefutable proof on your request, otherwise they simply cannot pursue you for payment.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

    You can, also, try sending MH the following 'prove it' letter, from National Debtline, via fermi:

    That will put the onus directly on MH to provide full details, including those of any CCJ.
