Dear all,
First post, so usual apologies if this is in the wrong place. There are several threads in a similar vein, but none that seemed to cover all the ground.
The situation: Water leaked through our ceiling from the flat above us on multiple occasions over several months. Each time, our upstairs neighbours were aware and promised to get it fixed. The cause of the leaks turned out to be nails driven through waterpipes (apparently predating our neighbours moving in). The damage to our ceilings and walls was covered by the buildings insurance. There was also damage to personal property, with a cost of repair that is below the excess on our contents insurance. Our neighbours won't pay for the damage to be repaired. One or even two leaks might be considered a normal hazard of living in flats. But so many leaks over so many monthsis surely negligent. I was thinking about going through the small claims process to recover the money.
Anyone any thoughts on whether it's worthwhile or even if I have a case?

Wont your insurers help you out? Either under liability or through any legal protection?0

I did speak to them, but didn't ask that specific question and they obviously didn't volunteer the information. Good tip, many thanks for the suggestion.0

Some home insurances include a free legal advice phoneline. The people you speak to aren't usually experts in one particular legal field so their advice isn't the best, but they should be able to point you in the right direction or let you know if you've got any hope of a case...0
