Claiming bankruptcy- can i move abroad?

Options
 Hi everyone, i was wandering if anyone would be able to help me.
I tried to set an IVA up when i had a job to ease the pressures and try and get my debt paid off, me creditors have chosen to ignore my letters and have continued to ask for money- ive tried my best to pay but now ive come to the end of my student overdraft and i no loonger have a job as i had to concentrate on finishing my studies and now ive moved to my boyfriends mums to get looked after...
Ive filled most of the bankruptcy forms in however i have a few concerns...
1) where can i get the money to pay the bancruptcy fees
2) Once im declred Bancrupt does it mean that i wont be able to live in a different country? My boyfriend has been offered a job in Crete and i want to go with him....

My boyfriend has debts too but he's on top of paying his (lucky sod) plus we are indpendant we dont touch each others finances...

I hope someone has some advice, im currently on jobs seekers allowance.

This has been posted in bankruptcy hasnt it? Unless it has been moved

Did you have an IVA set up? Are you still paying this each month, if so you need to stop if you are intending to go BR and get a letter from the IVA company saying that they agree to you petitioning for BR.
I *think* that you can not pay/claim back the £150 court fees if you are on certain benefits and assume that JSA is one of these, one of the more experienced people here will be able to give you more info on this. The remaining £345 admin fee is always payable so you would need to either borrow this from family, or save it up etc.
I have no idea about moving abroad im afraid.

    Hi there,

We tend to advise our clients to either save money they are already paying towards their creditors to save up for the fee over time, or see whether any friends or family can help club together to give you the money straight away. There are also a number of trust funds who can sometimes help with people in financial distress with grants to help with things like bankruptcy, but I would need to know more about your situation to do this, and there is certainly no guarantee that they can necessarily help.

There should be no restricition for you to move to Crete as a bankrupt. Sometimes it can cause issues if you are looking to move outside the EU, but Greece should cause you no problems.

Have you decided to go bankrupt yourself, or have you had some advice before coming to that decision?

    Hope this helps,
    CCCS

Hi, thanks for your help everyone, it makes me feel a bit better in this stormy cloud....
I was in touch with Debt free direct and they helped me with a payment plan- apologies i said it was an IVA it's not i just thought it was- my creditors ignored this payment plan and some said it was not acceptable etc...since then though i had to leave my job so i could focus on my degree...i was studying full time at drama school and the hours that i was to work at school would not let me fit any work hours in...
I got in touch with Debt free direct again and told them my situation and they said they they think Bankruptcy was the best idea for me and i had told them that i had been thinking about this for a while....i have no car and no house so i have nothing to lose. Apart from pride!
Im currently looking for a job applying for both full time positions and acting work too.. double stress...
I think i will see if i can beg and borrow from family members...
If i put my statement to the question of "what reasons do you think you cannot pay back your debts" would someone look over it and see if it makes sense? Ive a tendency to waffle and im not sure just how much information i need to sripulate...my life is pretty complex just now...eek!
    All help is welcome! xxx:p

I would get some impartial advice from one of the agencies Martin recommends. Banruptcy may or may not be your best option but getting advice from a fee charging company is not the best way. Try CCCS/CAB/Payplan etc.

Ok thanks, but Debt Free Direct isnt a fee charging company...
They got me intouch with a company who could sort everything out for me but they told me what i needed to do and then let me choose wether i wanted to fill the forms in myself or pay the company to do them...i said i would fill them in myself....then they checked how i was getting on and if i managed to obtain the forms and i had so they wished me luck and tole me they would be there if i needed help...
I have no money to pay my debts and im over £10,000 in credit card debt thats not including my overdraft and student loans etc (but i dont really count the student loans, well not yet anyway)

I think some posters (myself included) have had less than positive advice and experiences from Deft Free Direct. You might be better off giving CAB, CCCS or the national debtline a call.

Just a quick point, your student loan will not be included in bankruptcy and by all means shout up if you have any issues completing the forms, they can get a bit confusing. Feel free to pop up your statement about why you can;'t meet your commitments. I can't remember who exactly (apologies) posted in the last few days about keeping it to the point. Explain why you're in this position but don't make it a sob story if that makes any sense? (apologies if I offend with this last sentence, I don't mean it as though people don't have upsetting stories about how they got to this point, just that the OR will want to know the reasons but not the emotions.) Oh I'm rambling, hope you know what I mean! :)

thanks, yeah i thought that too, if im there stood in court the people reading wont want to hear the emotional side of things....

I will give one of those helpines a ring then i think...
Is what Debt Free Direct's advice turning out to be incorrect? They seemed so helpful and advised me to really think about it before deciding to claim bankruptcy and if i got any problems to get in touch with CAB. Aww, i was hoping to see the end of a dark tunnel...mind you a suppose the other people will be able to help...im just very scared just now because i ahve no money and im ending up paying some bills before buying my food, so i scrounging from my boyfriend...it hurts the pride of being an independant woman ive always tried to be...

Oh! Not moing to Crete anymore as my boyfriends job has fallen through...so i guess i can concentrate on getting my finances sorted...

Thanks again for helping me out it means a hell of a lot!

Will post my mission statement once i get back from signing on..i hate it!

    ok here goes....

The reason why i dont have enough money to pay off my debts are due to the fact that i have been studying full time at university for a degree in acting for the past three years. During this time i have had to live in private accomodation as the drama school i attended didnt provide student accomodation.

Within the three years of studying i have worked constantly up until the last two months of my course when my doctor signed me off with stress. Both pressures of work and drama school started to show in my mental health and ability to cope.

Whilst at drama school we were expected to purchase numerous equipment for our studies which became expensive along with the pressures of every day living. We were also required to work long hours each day and then study when we got home, thus making it extremly difficult and stressful to work to then pay off my credit card bills.

As the final two months of my course approached i realised from visiting my doctor that my debts were an underlying issue. Whilst working throughout the three years i tried to pay as much as i possibly could however the interest kept taking over and slowly increased my debt.

I have now finished my course which was in Manchester and i have moved to Yorkshire where my closest friend is looking after me until i get myself back on my feet. Im currently in benefit of Job seekers allowance and i have tried to make my last works payment last to cover my bills. This money has now gone and unfortunatly the JSA does not cover my bills along with my living needs.

It's a bit of a story i know but im not sure how else to put this?!

Any suggestions would be greatly appreciated :EasterBun
