The camera in your phone ~probably~ stores information about the picture in EXIF format within the picture file, and that should not be altered when you copy the file.
However, the date and time recorded with the photo will be when the photo was taken, not (for example) when you received it if someone else sent it to you in an MMS message.
The EXIF data cannot be relied on to prove anything about when a picture was taken because 1. It's easy to set the date and time wrong on the original camera and 2. there are loads of EXIF editors out there that allow you to change the data.0 -
it's just the pic has a date below it, which is now on memory card so am i right that that was the date it was either dated or recived to the phone not memory card?
all this tec stuff is way over my head...Ignore reality. There's nothing you can do about it.

The date is when the picture was taken or altered.
As has been stated it is easy to deliberately or accidently set a camera to the wrong date."A nation's greatness is measured by how it treats its weakest members." ~ Mahatma Gandhi

It's difficult to say whether the phone is getting the date from the file attributes or the EXIF data.
If you take the card out of the phone and connect it to a PC via a card reader, you can see both sets of information if you have Windows XP or Vista.
If you use Windows Explorer to access the memory card and right-click on the picture file, you can see the file attributes (date created, modified and last accessed) under the General tab and the photo's EXIF attributes under Summary, Advanced. The EXIF property "Date picture taken" is the most credible date to rely on, but as stated earlier it wouldn't hold up in court.
All of these dates can be changed, either accidentally, or deliberately if you know how.0
